Placed on Fi"rs~'.,Rea~..,i~ng 7-15-85 <br />Placed on Second Read~ng 9-3-85 <br /> <br />ORDINANCE 54-85 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> Salmon, Wendling <br /> <br /> AN ORDINANCE to supplement Section 1111.04 of the Zoning Code <br />of the Codified Ordinances of the City of Lakewood by enacting new paragraph <br />(b) to permit business and medical offices and service oriented business <br />to replace non-conforming uses being vacated in an M2 district. <br /> <br /> WHEREAS, the vacation of existing non-conforming uses in M2 districts <br />has an adverse effect upon the condition of the neighborhoods where such non- <br />conforming use is located, and <br /> <br /> WHEREAS, permitting professional and medical offices and services <br />oriented businesses to replace non-conforming uses in the M2 district would <br />reduce said impact upon the neighborhood and would be in the best interest <br />of the community at large; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br />OHIO: <br /> <br /> Section 1. That Section 1111.04 of the Zoning Code of the <br />Codified Ordinances of the City of Lakewood shall be and the same is <br />hereby supplemented by enacting new paragraph (b) to read as follows: <br /> <br />1111.04 SPECIAL EXCEPTION <br /> <br />The following uses if approved by the Board of Zoning <br />Appeals after public notice and public hearing, may be <br />permitted as a special exception provided that the <br />conditions hereinafter specified are met:. <br /> <br /> (b) Professional and medical offices and general <br />business offices provided: (1) that the proposed use <br />replaces an existing non-conforming use and is determined <br />by the Board to be a lower use than the existing non- <br />conforming use being vacated; (2) that the proposed <br />use is located only on the ground floor of the building; <br />(3) that no variances are required to accommodate the <br />proposed use; and (4) that the required off street parking <br />for all occupancies is available on the same parcel. <br /> <br /> Section 2. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this ordinance <br />were adopted in an open meeting of this Council, and that all such deliberations <br />of this Council and of any of its committees that resulted in such formal <br />action, were in meetings open to the public, in compliance with all legal <br />requirements including Section 121.22 of the Ohio Revised Code. <br /> <br /> <br />
