ORDINANCE NO. 67-85 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the <br />Mayor on behalf of the City of Lakewood to accept a $62,500 <br />grant to the City and to enter a MEM Program Grant Agreement with <br />the Department of Development of the State of Ohio. <br /> WHEREAS, the Department of Development of the State of <br />Ohio is mandated by Ohio Revised Code Section 1551.05(I) to <br />"Implement continuing public education effort . · .about specific <br />ways to conserve energy.", and <br /> <br /> WHEREAS, the Department of Development has available <br />for the benefit of the City funds in the amount of $62,500 to <br />assist in defraying a portion of the expenses associated with the <br />foregoing, and <br /> <br /> WHEREAS, it is in the best interest of the City to <br /> establish a full time position of Municipal Energy Manager (MEM), <br /> and to participate in the Ohio Municipal Energy Manager Grant <br /> Program, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br /> measure providing for the immediate preservation of the public <br /> health and welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br /> STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby <br /> authorized and directed on behalf of the City of Lakewood to <br /> accept a grant in the amount of $62,500 and to enter into a MEM <br /> Program Grant Agreement with the Department of Development of the <br /> State of Ohio, said Agreement to be substantially in the form of <br /> EXhibit "A" attached hereto and made a part hereof as if fully <br /> rewritten herein. <br /> <br /> Section 2. It is found and determined that all formal <br /> actions of this Council concerning and relating to the passage of <br /> this ordinance were adopted in an open meeting of this Council, <br /> and that all such deliberations of this Council and of any of its <br /> committees that resulted in such formal action, were in meetings <br /> open to the public, in compliance with all legal requirements <br /> including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to <br /> be an emergency measure for the reasons stated in the pzeamble <br /> hereof and provided it receives the affirmative vote of two- <br /> thirds of all members elected to Council, it shall take effect <br /> and be in force immediately upon its adoption and approval by the <br /> Mayor; otherwise, it shall take effect and be in force after the <br /> earliest period allowed by law. <br /> <br /> U ~RES IDENT -- <br /> <br />Approve~ <br /> <br /> <br />
