Placed on First Reading: Oct. 6, 1986 <br />Placed on Second Reading: Oct. 20, 198( <br /> <br />ORDINANCE NO. 105-86 BY: Gallagher, Graham, McBride, <br /> Wendling <br /> <br /> AN ORDINANCE to supplement Chapter 1119 of the Zoning Code <br />of the Codified Ordinances by enacting new Section 1119.16 to permit <br />boutiques as an accessory use in residential districts of the City <br />subject to certain standards and.conditions. <br /> <br /> WHEREAS, this Council determines it to be in the best <br />interest of the City to permit boutiques to be conducted as an <br />accessory use in the residential districts of the City during the <br />Christmas holiday season subject to certain standards and conditions; <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That Chapter 1119 of the Zoning Code of the <br />Codified Ordinances of the City of Lakewood shall be and the same is <br />hereby supplemented by enacting new Section 1119.16 to read as <br />follows: <br /> <br />1119.16 BOUTIQUE OPERATING STANDARDS. <br /> <br />Boutiques may be permitted as an accessory use in <br />R1, R2, M1 and M2 districts subject to the <br />following operating standards and conditions: <br /> <br />(a) No boutique shall be opened for business <br /> without a valid permit issued by the <br /> Building Commissioner, for which permit <br /> a fee of Ten ($10.00) Dollars shall be <br /> charged; <br />(b) No permit shall be issued to any person <br /> not an owner and resident of the <br /> premises for which the permit is <br /> requested; <br />(c) Not more than one permit per calendar <br /> year shall be issued for any one <br /> premises; <br />(d) Permits issued hereunder shall be <br /> limited to not more than three <br /> consecutive days and shall only be <br /> effective during the period between <br /> November 1 through December 31 of each <br /> year. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public, in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> <br /> Section 3.
