ORDINANCE NO. <br /> <br />19-86 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendl ing <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Economic <br />and Community Development of the City of Lakewood to purchase certain <br />real property known as a part of PP#312-29-107, located at 1280 <br />Clifton Prado, in Lakewood, Ohio, hereinafter more particularly <br />described and subject to the terms and conditions hereinafter set <br />forth. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health .and <br />welfare and for the usual daily operation of a municipal department <br />and for the further reason that the owner has agreed to sell said <br />property for the consideration herein stipulated and this Council <br />determines it to be in the best interest of the City that the property <br />be purchased immediately so that the Clifton Prado Improvement <br />Project can be commenced without delay; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> OF OHIO: <br /> <br /> Section 1. That the Director of Economic and Community <br /> Development of the City of Lakewood be and he is hereby authorized and <br /> directed to purchase from Henry & Deborah Gates, the following <br /> described property: <br /> <br /> Parcel 1: Beginning at the northeasterly corner of a <br /> parcel of land conveyed to Henry A. and Deborah J. Gates by deed <br /> recorded in Volume 14459, Page 473 of Cuyahoga County Official <br /> Records; thence West, 11.50 feet along the northerly line of said <br /> parcel; thence South, 40.00 feet to the southerly line of said parcel; <br /> thence East, 11.50 feet along said southerly line to the southeasterly <br /> corner thereof; thence North, 40.00 feet along the easterly line of <br /> said parcel to the place of beginning and containing 0.01056 of an <br /> acre of land as calculated and described by William J. Haas, P.S. <br /> #4793 for the City of Lakewood from a survey made in July, 1984 by <br /> James B. Root and Associates. <br /> i~ Parcel 2: AN UNDIVIDED ONE-TWENTY SECOND INTEREST IN THE <br /> FOLLOWING DESCRIBED PREMISES: Situated in the City of Lakewood, <br /> County of Cuyahoga and State of Ohio, and known as being part of <br /> Sublots Nos. 54 and 55, and part of a 20 foot Alley in the Henry Beach <br /> Subdivision of part of Lot No. 60 in Original Rockport Township, <br /> Section No. 21, as shown by the recorded .plat in Vol. 30 of Maps, Page <br /> 4 of Cuyahoga County Records and together forming a parcel of land <br /> bounded and described as follows; Beginning at a point on the Easterly · <br /> line of Beach Avenue, due South 216 feet measured along said Easterly <br /> line from the Southwesterly line of Clifton Blvd., said point being <br /> also the intersection of said~ Easterly line with the Southerly line of <br /> a 20 foot driveway, 235.13 feet to the Easterly line of said Sublot <br /> No. 54; thence due North along said Easterly line, 10 feet to the <br /> center line of said driveway; thence due West along said center line, <br /> 235.13 feet to the Easterly line of Beach Avenue; thence due South <br /> along said Easterly line, 10 feet to the place of beginning, as <br /> appears by said plat, be the same more or less but subject to all <br /> legal highways. <br /> <br /> and to pay therefore the sum of Eight Hundred fifty dollars and <br /> thirty-two cents ($850.32). <br /> <br /> <br />
