ORDINANCE NO: 27-86 <br /> <br /> McBride, Salmon, Wendling, <br />BY: Brown, Chinnock, Gallagher, Graham <br /> <br />AN EMERGENCY ORDINANCE authorizing the Director of Public Works, to advertise <br />for bids and to enter into a contract for the operation of the Concession Stands <br />located at Lakewood Park, Madison Park, and Winterhurst Ice Skating Rink for the <br />City of Lakewood, Ohio with the lowest and best bidder or bidders as provided by <br />· law. Lowest bidder shall be determined by the highest guaranteed yearly rental <br /> or a fixed percentage of the gross receipts as defined in the bid specifications, <br /> whichever is the greater amount, with both amounts submitted by the bidder. <br /> <br />WHEREAS, this ordinance constitutes an emergency measure in that it provides for <br />the immediate preservation of the public health, safety and welfare and for the <br />usual daily operation of a municipal department; now, therefore; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Director of Public Works, be and is hereby authorized and <br />directed to enter into a contract for the operation of Concession Stands located <br />at Lakewood Park, Madison Park and Winterhurst Ice Skating Rink for the City of <br />Lakewood, Ohio with the lowest and best bidder or bidders after advertisement as <br />provided by law, on approval by Council. <br /> <br />Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in a open <br />meeting of this Council, and that all such deliberations of this Council and of <br />any of its committees that resulted in such formal action, were in meetings open <br />to the public, in compliance with all legal requirements including Section 121.22 <br />of the Ohio Revised Code. <br /> <br />Section 3. That this ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of. two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br />Adopted:,,,~~:2x~ /oOy /~o~:~ p~ <br /> <br /> Clerk <br />Approved :~ ~ <br /> <br /> <br />
