ORDINANCE NO: 48-86 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Public Works <br />Director to advertise for bids and to enter into a contract <br />with the lowest and best bidder after advertisement according <br />to law for the installation of new service connections on <br />Madison Avenue between Mopkins Avenue and Grace Avenue in <br />the City of Lakewood. <br /> <br /> WHEREAS, Council has determined the existing 6-inch <br />water main on Madison Avenue between Hopkins Avenue and Grace <br />Avenue is badly deteriorated, and <br /> <br /> WHEREAS, Council has determined abandonment of <br />the existing 6-inch water main will necessitate the installation <br />of new service connections to an existing 16-inch water main, <br />and <br /> <br /> WHEREAS, this Council has authorized the preparation <br />of construction drawings and specifications by the Lakewood <br />Engineering Department, and <br /> <br /> WHEREAS, the aforementioned construction drawings <br />and specifications are now on file in the City Engineer's <br />office, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency <br />measure providing for the usual daily operation of a municipal <br />department and for the immediate preservation of the public <br />safety and welfare; now, therefore <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF 0HIO: <br /> <br /> Section 1. That the Public Works Director be and <br />he is hereby authorized and directed to advertise for bids <br />and to enter into a contract with the lowest and best bidder <br />after advertisement according to law for the installation <br />of new service connections on Madison Avenue between Hopkins <br />Avenue and Grace Avenue in the City of Lakewood. <br /> <br /> Section 2. That the cost of such construction is <br />estimated at $50,000, which funds are to be made available <br />from the Water Fund. <br /> <br /> Section 3. It is found and determined that all <br />formal actions of this Council concerning and relating to <br />the passage of this ordinance were adopted in an open meeting <br />of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal <br />action, were in meetings open to the public, in compliance <br />with all legal requirements including Section 121.22 of the <br />Ohio Revised Code. <br /> <br /> Section 4. That this Ordinance is hereby declared <br />to be an emergency measure for the reasons stated in the <br />preamble hereof and provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption <br />and approval by the Mayor; otherwise it sha~ll~ke effect <br />and be in force after the earliest per~~ed~by l~w <br /> <br />Adopted: <br /> <br /> <br />
