ORDINANCE NO. 74-86 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend Section 1701.05 of the Sanitary Code of the Codified Ordinances of the City of Lakewood authorizing the Mayor to commission certain employees of the Division of Health as special police officers :subject to certain limitations and restrictions. WHEREAS, in order to more efficiently and effectively enforce Health Code violations, particularly those violations relating to nuisances which sbould be abated at the earliest possible time, this'Council determines it to"be in the best interest of the City that certain employees of the Division of Health, Department of Public Safety, be given the authority to issue citations and other powers in connection with the enforcement of the ordinances of the City within their jurisdiction, subject to certain limitations and restrictions, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health~ safety and welfare and for the usual daily operation of a municipal department; now, therefore, OF OHIO: BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE Section 1. That Section 1701,05 of the Sanitary Code of the Codified Ordinances of the City of Lakewood now reading as follows: 1701.05 POWERS OF HEALTH OFFICERS. The health officers and the sanitary officers of the City shall have the same power to make arrests as is by ordinance and law conferred upon the regular police of the City, in all cases where any person shall violate the statutes, ordinances, orders, rules or regulations relating to the health of the City. shall be and the same is hereby amended to read as follows: 1701.05 SPECIAL POLICE OFFICERS. A. The Mayor is authorized to commission the Division of Health Sanitation Officers, Litter Control Officer and the Animal Warden as special police officers. B. The following rules shall apply to such special police officers and their commissioning: 1. The special police officers shall receive no additional compensation for their duties as such; 2. The special police officers shall not be on the classified list of the Police Department nor eligible for participation in the Police Pension Fund. 3. The special police officers shall have the powers to issue misdemeanor citations and/or complaints and order the abatement of nuisances in the exercise and performance of their duties as set forth in the Health and General Offenses Codes of the City, and other
