PLEASE SUBSTITUTE FOR ORDINAi~CE <br />74-86 SUBMITTED WITH DOCKET. <br /> <br />ORDINANCE NO. 74-86 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 1701.05 of the <br />Sanitary Code of the Codified Ordinances of the City of Lakewood <br />authorizing the Mayor to commission certain employees of the Division <br />of Health as special police officers :subject to certain limitations <br />and restrictions. <br /> <br /> WHEREAS, in order to more efficiently and effectively <br />enforce Health Code violations, particularly those violations relating <br />to nuisances which sbould be abated at the earliest possible time, <br />this'Council determines it to"be in the best interest of the City that <br />certain employees of the Division of Health, Department of Public <br />Safety, be given the authority to issue citations and other powers in <br />connection with the enforcement of the ordinances of the City within <br />their jurisdiction, subject to certain limitations and restrictions, <br />and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health~ safety <br />and welfare and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br />OF OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br /> Section 1. That Section 1701,05 of the Sanitary Code of <br />the Codified Ordinances of the City of Lakewood now reading as <br />follows: <br /> <br />1701.05 POWERS OF HEALTH OFFICERS. <br /> <br />The health officers and the sanitary officers of <br />the City shall have the same power to make arrests <br />as is by ordinance and law conferred upon the <br />regular police of the City, in all cases where any <br />person shall violate the statutes, ordinances, <br />orders, rules or regulations relating to the health <br />of the City. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />1701.05 SPECIAL POLICE OFFICERS. <br /> <br />A. The Mayor is authorized to commission the <br />Division of Health Sanitation Officers, Litter <br />Control Officer and the Animal Warden as special <br />police officers. <br /> <br />B. The following rules shall apply to such special <br />police officers and their commissioning: <br /> 1. The special police officers shall <br /> receive no additional compensation for <br /> their duties as such; <br /> 2. The special police officers shall not be <br /> on the classified list of the Police <br /> Department nor eligible for <br /> participation in the Police Pension <br /> Fund. <br /> 3. The special police officers shall have <br /> the powers to issue misdemeanor <br /> citations and/or complaints and order <br /> the abatement of nuisances in the <br /> exercise and performance of their duties <br /> as set forth in the Health and General <br /> Offenses Codes of the City, and other <br /> <br /> <br />
