ORDINANCE NO. 81-86 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor <br />ex-officio Director of Public Safety to issue a permit to the Downtown <br />Lakewood businesses to conduct a sidewalk sa)e on Detroit Avenue between <br />Lincoln Avenue and Mars Avenue on Thursday, Ju~ly 17; Friday, July 18; and <br />Saturday, July 19, lgB6, between the hours of l0 a.m. and 6:00 p.m. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the usual daily operation of a'municipal department; now, therefore, <br /> <br />OHIO: <br /> <br />BE 1T ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE ~F <br /> <br /> Section 1. That notwithstanding the provision of Section 1667.17 <br />of the Regional Building Code and the provision of Section 901.18 of the <br />Streets and Public Services Code of the Codified Ordinances of the City of <br />Lakewood, the Mayor, as ex-officio Directoriof Public Safety; be and he is <br />hereby authorized and directed to issue a permit to the Downtown Lakewood <br />businesses to conduct a sidewalk sale on Detroit Avenue between Lincoln <br />Avenue and Mars Avenue, im the City on Thursday, July 17; Friday, July 18; <br />and Saturday, July 19, between the hours of lO:O0 a.m. and 6:00 p.m. No more <br />than fifty per cent (50%) of the sidewalk width abutting participating stores <br />shall be occupied by displays, which occupied portion of the sidewalk shall <br />be that portion immediately adjacent to the principal structure. <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations <br />of this Council and of any of its committees that resulted in such formal <br />action were in meetings open to the public in compliance with all legal <br />requirements, including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect'and be in force immediately upon its adoption and approval <br />by the Mayor; otherwise, it shall take effect and be in force after the <br />earliest period allowed by law. <br /> <br />Adopted: <br /> <br />C LEl~K ' <br /> <br />Approved~~~ /~ ~ <br /> <br /> <br />
