ORDINANCE NO. 93-86 <br /> <br />BY: Chinnock, Gallagher, Graham, <br /> Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor <br />ex-officio Director of Public Safety to issue a permit to Mr. Richard A. <br />Bottiglier, the owner of the Castle of Treasures, to conduct a sidewalk sale <br />at 13737 Madison Avenue on Thursday, September 18; Friday, September 19; and <br />Saturday, September 20, 1986, between the hours of 10 a.m, and 6 p.m. <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the usual daily operation of a municipal department; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> OHIO: <br />Section 1. That notwithstanding the provision of Section 1667. 17 <br />of the Regional Building Code and the provision of Section 901.18 of the <br />Streets and Public Services Code of the Codified Ordinances of the City of <br />Lakewood, the Mayor, as ex-officio Director of Public Safety, be and he is <br />hereby authorized and directed to issue a permit to Mr. Richard A. <br />Bottiglier, the owner ,~ Castle of Treasures, to conduct a sidewalk sale at <br />13737 Madison Avenue in'~he City on Thursday, September 18; Friday, September <br />19; and Saturday, Sep~e~ber 20, between the hours of 10:00 a.m. and 6:00 p.m. <br />No more than fifty per cent (50%) of the sidewalk width abutting <br />participating stores st~'~ll be occupied by displays, which occupied portion of <br />the sidewalk shall b~..~that portion immediately adjacent to the principal <br /> structure. ~ <br /> Section 2. it is found and determined that all formal actions of <br /> this Council concernin~ and relating to the passage of this ordinance were <br /> adopted in an open me(~ing of this Council, and that all such deliberations <br /> of this Council and of any of its committees that resulted in such formal <br /> action were in meetings open to the public in compliance with all legal <br /> requirements, including Section 121.22 of the Ohio Revised Code. <br /> Section 3. That this ordinance is hereby declared to be an <br /> emergency measure for 'he reasons stated in the preamble hereof and provided <br /> it receives the aff~'~'mative vote of two-thirds (2/3) of all members of <br /> Council, it shall tak~ effect and be in force i~nediately upon its adoption <br /> and approval by the ~a~yor; otherwise, it shall take effect and be in force <br /> after the earliest pe~od allowed by 1 . <br /> <br /> Adopted:~~/~//~ <br /> <br /> <br />
