ORDINANCE NO. 3-87 BY:Brown, Chinnock, Galllagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE repealing Section 769.07 of the Business Regulation Code of the Codified Ordinances of the City of Lakewood relating to the requirements for the issuance of taxicab drivers' licenses to females. WHEREAS, Section 769.07 of Chapter 769 entitled "Taxicabs" of the Business Regulation Code of the Codified Ordinances of the City of Lakewood provides for time limits during which female taxicab drivers may operate their cabs and for other reasonable regulations as the Director of Public Safety shall determine to be necessary, and WHEREAS, this Council concurs with the findings of its Commercial Development Committee that such Code provision is discriminatory and should be repealed forthwith, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare; now, therefore, OF OHIO: BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE Section 1. That Section 769.07 of the Business Regulation Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 769.07 REQUIREMENTS FEMALES. FOR ISSUANCE OF LICENSE TO The Director of Public Safety is hereby authorized to issue a taxicab driver's license to any female applicant therefor who shall comply with the requirements of this chapter, provided that such license shall limit the time during which such female may operate thereunder to the period beginning at 6:00 a.m. and ending at 8:00 p.m. and that it shll be subject to such further reasonable regulations as the Director of Public Safety shall determine to be necessary for the safety and protection of such licensees and the public. shall be and the same is hereby repealed. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements. Section 3.
