ORDINANCE NO. <br /> <br />8-88 BY: <br /> <br />Brown, Chinnock, Gal lagher, <br />Gazzana, George, Graham, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor for and on behalf <br />of the City of Lakewood to enter into a contract with the Tom Paige <br />Catering Company to provide meals to the residents of the Assisted <br />Living Facility known as the South Westerly Apartments. <br /> WHEREAS, the management of the Assisted Living complex known <br />as the South Westerly Apartments situated in the City of Lakewood <br />terminated the meals served to the residents of said apartments for <br />sundry reasons, and <br /> WHEREAS, this Council, by adoption of Ordinance 106-86, authorized <br />the City to enter into a contract with Tom Paige Catering Company to <br />provide meals to the residents of the South Westerly Apartments, and <br /> WHEREAS, under the auspices of the Department on Aging, the <br />operation.of the aforementioned meal program has been most successful <br />and should be continued preferably with the contract being effective <br />on a calendar year basis, and <br /> WHEREAS, Council determined the Tom Paige Catering Company is <br /> most qualified to provide meals to the residents of the South Westerly <br /> Apartments and it is in the best interests of the City to enter into <br /> a contract with said Company to be effec'tive through December 31, 1988, and <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br /> for the immediat~ preservation of the pulblic health and welfare and for <br /> the daily operation of a municipal department; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized for <br /> and on behalf of the City of Lakewood to enter into a contract with <br /> the Tom Paige Catering Company, 2275 East 55th Street, Cleveland, Ohio, <br /> 44103, to provide meals to the residents of the South Westerly Apartments, <br /> said contract to be substantially in the form of Exhibit "A" attached <br /> hereto and made a part hereof as if fully rewritten herein. <br /> Section 2. It is found and determined that all formal actions <br /> of this Council concerning and relating to the passage of this ordinance <br /> were adopted in an open meeting of this Council, and that all such <br /> deliberations of this Council and of any of its committees that resulted <br /> in such formal action, were in meetings open to the public, in compliance' <br /> with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be an <br /> emergency measure for the reasons stated in the preamble hereof and <br /> provided it receives the affirmative vote of two-thirds of all members <br /> elected to Council, it shall take effect and be in force immediately <br /> upon its adoption and approval by the Mayor; otherwise, it shall take <br /> effect and be in force after the earliest period allowed by law. <br /> <br />PRESIDENT <br /> <br /> <br />
