ORDINANCE NO. 46-88 <br /> <br />BY: Brown, Gal lagher, Gazzana <br /> George, Graham, Wend]in§ <br /> <br /> AN EMERGENCY ORDINANCE to provide a Mediation Program for <br />the City of Lakewood and to authorize the Director of Law, or his <br />designee, to establish such rules and regulations as may be necessary <br />for the conduct of same. <br /> <br /> WHEREAS, the need for a mediation program having been <br />demonstrated, this Council determines that it is in the best interest <br />of the City to formally provide for such a program and the <br />establishment of such rules and regulations as may be necessary to <br />conduct same, and <br /> <br /> WHEREAS, funds have already been budgeted and appropriated <br />to cover the cost of operating a mediation program for the balance of <br />the calendar year 1985, and <br /> <br /> WHEREAS, Council further determines that the mediation <br />program should be conducted under the auspices and direction of the <br />Law Department of the City, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public welfare and for <br />the usual daily operation of a municipal department; now, therefore, <br /> <br />OF OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br /> Section 1. There is hereby formally established in and for <br />the City of Lakewood a Mediation Program which program shall be <br />conducted under the auspices and direction of the Law Department of <br />the City of Lakewood. <br /> <br /> Section 2. The Director of Law, or his designee, is hereby <br />authorized and directed to establish such rules and regulations as may <br />be necessary to conduct the mediation program provided for herein and <br />to secure the services of persons who shall act as mediators for said <br />program. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />Approved:~ <br /> <br />PRESIDENT <br /> <br /> <br />
