ORDINANCE NO. 80-88 <br /> <br />BY: <br /> <br />Brown, Gallagher, Gazzana, <br />George, Graham <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Public <br />Works to enter into a contract with Instituform East, Inc. for the <br />replacement of the sanitary and storm sewers under the railroad tracks <br />on Ethel Avenue,- approximating 200 feet in distance for each pipe <br />from manhole to manhole. <br /> <br /> WHEREAS, it has been determined that an.emergency situation <br />exists as a consequence of the collapse of the storm sewer on Ethel <br />Avenue underneath the railroad tracks and that the sanitary sewer <br />therein is badly deteriorated and in urgent need of repacement, and <br /> <br /> WHEREAS, an <br />corrected, could pose <br />safety and welfare, and <br /> <br />emergency condition exists <br />a significant hazard to the <br /> <br />which, if. not <br />public health, <br /> <br /> WHEREAS, the Director of Public Works has determined that <br />the best and most expedient method of correction of this emergency <br />condition would be use of the Instituform piping system, and <br /> <br /> WHEREAS, such system has been used in the past by the <br />Department of Public Works to effect such repairs and the results from <br />same have been excellent, and <br /> <br /> WHEREAS, it has been determined that such <br />materials are available from only one source, that <br />East, Inc., and <br /> <br />system and/or <br />is Instituform <br /> <br /> WHEREAS, Council has determined that '~urs~ant to Section <br />111.04 of the Codified Ordinances an emergency situation exists which <br />requires immediate action for the preservation of the public health, <br />safety and welfare and that the most expedient system for the <br />correction of such hazardous condition is available from only one <br />source, that is, Instituform East, Inc., and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department and <br />for the immediate preservation of the public health, safety and <br />welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1, It is'hereby determined pursuant to Section <br />111.04 of the Codified Ordinances that it is impractical to award the <br />contract designated.herein under competitive bidding procedures and it <br />is most cost effective and in the best interest of the City to award <br />such contract without competitive bidding because of the emergency <br />effecting the public health, safety Dnd welfare and the fact that the <br />best method for correction of such emergency situation and <br />preservation of the public health, safety and welfare is in a piping <br />system which is available only from one source, Intituform East, Inc. <br /> <br /> Section 2. That the Director of Public Works be rand is <br />hereby authorized and directed to enter into a contact with <br />Instituform East, Inc. in an amount not exceeding $ 55,000.00, for the <br />repair/replacement of 200 feet of sanitary and 200 feet of storm sewer <br />on Ethel Avenue to correct the current collapsed sewer. <br /> <br />Section <br />Lakewood <br />Control. <br /> <br /> Section 3. That such contract be in the form as provided in <br />111.04(a)(10) of the Codified Ordinances of the City of <br /> and provided such contract is approved by the Board of <br /> <br /> <br />
