ORDINANCE NO. 90-88 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Gazzana, George, Graham, Wend]lng <br /> <br /> AN EMERGENCY ORDNANCE authorzing the Director of Public <br />Works to enter into a contract with Fairbanks Scale for the purchase <br />of six load cells for the repair of the Fairbanks scale at the <br />Lakewood Wastewater Treatment Plant. - <br /> <br /> WHEREAS, it has been determined that an emergency situation <br />exists as a consequence of damage by lightning to the Fairbanks scale <br />at the Wastewater Treatment Plant and that repairs are urgently <br />required for the continued operation of the Plant, and <br /> <br /> WHEREAS, an emergency condition exists, which if not <br />corrected could pose a significant hazard to the public health, safety <br />and welfare, and <br /> <br /> WHEREAS, the Director of Public Works has determined that <br />the only method of repair and correction of this emergency condition <br />is the purchase of six load cells from Fairbanks Scale, and <br /> <br /> WHEREAS, it has been determined that Fairbanks Scale is the <br />only source from which the load cells necessary to repair the scale <br />can be obtained, and <br /> <br /> WHEREAS, Council has determined that pursuant to Section <br />111.04 of the Codified Ordinances an emergency situation exists which <br />required immediate action for the preservation of the public health, <br />safety and welfare and that the only means for repair and correction <br />of the hazardous condition is the purchase of parts from the sole <br />source or supplier, Fairbanks Scale, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department and <br />for the immediate preservation of the public health, safety and <br />welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. It is hereby determined pursuant to Section <br />111.04 of the Codified Ordinances that it is impractical to award the <br />contract designated under competitive bidding procedures and that it <br />is most cost effective and in the best interest of the City to award <br />such contract without competetive bidding because of the emergency <br />situation existing affecting the public health, safety and welfare. <br /> <br /> Section 2. It is further determined that the only method for <br />the correction of such emergency situation and the preservation of the <br />public health, safety and welfare, is the purchase of the repair <br />parts, six load cells, from the sole supplier, Fairbanks Scale. <br /> <br /> Section 3. That the Director of Public Works be and he is <br />hereby authorized and directed to enter into a contract with Fairbanks <br />Scale in an amount not to exceed $12,000 for the purchase of the six <br />load cells necessary to repair the scale at the Lakewood Wastewater <br />Treatment Plant. <br /> <br />Section <br />Lakewood <br />Control. <br /> <br /> Section 4. That such contract be in the form as provided in <br />lll.04(a)(10) of the Codified Ordinances of the City of <br /> and provided such contract is approved by the Board of <br /> <br /> Section 5. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br />1 <br /> <br /> <br />
