ORDINANCE NO. 90-88 BY: Brown, Chinnock, Gallagher, Gazzana, George, Graham, Wend]lng AN EMERGENCY ORDNANCE authorzing the Director of Public Works to enter into a contract with Fairbanks Scale for the purchase of six load cells for the repair of the Fairbanks scale at the Lakewood Wastewater Treatment Plant. - WHEREAS, it has been determined that an emergency situation exists as a consequence of damage by lightning to the Fairbanks scale at the Wastewater Treatment Plant and that repairs are urgently required for the continued operation of the Plant, and WHEREAS, an emergency condition exists, which if not corrected could pose a significant hazard to the public health, safety and welfare, and WHEREAS, the Director of Public Works has determined that the only method of repair and correction of this emergency condition is the purchase of six load cells from Fairbanks Scale, and WHEREAS, it has been determined that Fairbanks Scale is the only source from which the load cells necessary to repair the scale can be obtained, and WHEREAS, Council has determined that pursuant to Section 111.04 of the Codified Ordinances an emergency situation exists which required immediate action for the preservation of the public health, safety and welfare and that the only means for repair and correction of the hazardous condition is the purchase of parts from the sole source or supplier, Fairbanks Scale, and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department and for the immediate preservation of the public health, safety and welfare; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. It is hereby determined pursuant to Section 111.04 of the Codified Ordinances that it is impractical to award the contract designated under competitive bidding procedures and that it is most cost effective and in the best interest of the City to award such contract without competetive bidding because of the emergency situation existing affecting the public health, safety and welfare. Section 2. It is further determined that the only method for the correction of such emergency situation and the preservation of the public health, safety and welfare, is the purchase of the repair parts, six load cells, from the sole supplier, Fairbanks Scale. Section 3. That the Director of Public Works be and he is hereby authorized and directed to enter into a contract with Fairbanks Scale in an amount not to exceed $12,000 for the purchase of the six load cells necessary to repair the scale at the Lakewood Wastewater Treatment Plant. Section Lakewood Control. Section 4. That such contract be in the form as provided in lll.04(a)(10) of the Codified Ordinances of the City of and provided such contract is approved by the Board of Section 5. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. 1
