<br /> AN EMERGENCY ORDINANCE creating positions and fixing salaries
<br />of the annual salaried sworn personnel in the Division of Police in
<br />the Department of Public Safety except the Police Chief, effective
<br />January 1, 1989, and repealing all other ordinances or parts of
<br />ordinances inconsistent therewith.
<br />
<br /> WHEREAS, this ordinance constitutes an emergency measure
<br />providing for the immediate preservation of the public health, safety,
<br />and welfare, and for the usual daily operation of a municipal
<br />department in that in the interest of the public welfare and safety,
<br />it is necessary to create positions and fix the compensation employees;
<br />now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. Positions are hereby created and the compensation
<br />of the annual salaried, sworn personnel in the Division of Police,
<br />Department of Public Safety, with 'the exception of the Chief of
<br />Police, shall be as follows effective January 1, 1989, pursuant to the
<br />terms of the agreement between the City of Lakewood and Western
<br />Cuyahoga Lodge No. 25, Fraternal Order of Police, Lakewood Division,
<br />effective January 1, 1989 through December 31, 1989.

<br /> Section 2. In the Division of Police, Department of Public
<br />Safety, Grade 1 Patrol Officer shall consist of Patrol Officers who
<br />have continuously served in the Division of Police four (4) full years
<br />or who, in the judgment of the Director of Public Safety, have
<br />acquired equivalent training and acquired experience in the Division
<br />of Police in some other City. Grade 2 Patrol Officer shall consist of
<br />Patrol Officers who have served continuously in the Division of Police
<br />for more than two (2) years but less than four (4) years. Grade 3
<br />Patrol Officer shall consist of Patrol Officers who have served in the
<br />Division of Police for less than two (2) years. Provided, however,
<br />that there shall be no increase in salary to any employee by reason of
<br />the said grouping until certified by the Director of Public Safety.

<br /> Section 3. Notwithstanding the other provisions contained
<br />in this ordinance and in consideration of the Collective Bargaining
<br />Agreement referred to above, in addition to the salary specified
<br />herein, any sworn personnel who are exempt from representation by
<br />the recognized bargaining unit shall be entitled to any and all
<br />benefits afforded the members of such bargaining unit. Such provision
<br />shall apply to the Chief of Police save for overtime benefits to which
<br />the Chief of Police shall not be entitled.
