ORDINANCE NO. 30-89 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> George, Graham, Webdl lng <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Public <br />works to sell certain property located in the right-of-way in front of <br />Rego's Supermarket at 14013 Detroit Avenue, to Riser Foods. <br /> <br /> WHEREAS, the property located at 14013 Detroit Avenue in the <br />public right-of-way shown in Parcel 1 and Parcel 2 attached hereto and <br />incorporated by reference herein as Exhibits is presently part of the <br />public right of way used as a sidewalk in front of Rego's <br />Supermarket, and <br /> <br /> WHEREAS, Riser Foods desires to remodel the Rego's <br />Supermarket at that location and to totally redesign the facade and <br />store entrance, and <br /> <br /> WHEREAS, such renovation and remodeling will <br />improvement to the area and enhance the neighborhood as well <br />entire community, and <br /> <br />be an <br />as the <br /> <br /> WHEREAS, this change in design creates a condition and <br />circumstance which demonstrates that the aforementioned property is no <br />longer needed or suited for any municipal purpose., and <br /> <br /> WHEREAS, this ordinance constitutes an emergency in that it <br />provides for the immediate preservation of the public health, safety <br />and welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council determines that the property <br />described in Parcel 1 and Parcel 2 of the Exhibits attached hereto are <br />no longer suited or needed for any municipal purpose and should be <br />sold and that said sale is in the best interest of the City. <br /> <br /> Section 2. That this Council determines that the sale of <br />the aforementioned property will further the interest of all of the <br />citizens of this City. <br /> <br /> Section 3. That the Director of Public Works is hereby <br />authorized to sell said property for a total sum of $2,500.00 to Riser <br />Foods. <br /> <br /> Section 4. That the Director of Public Works is hereby <br />authorized to enter into a contract prepared by the Director of Law <br />and approved by the Director of Control for the sale of said property <br />and that the conveyance will be in the usual form of quit claim deed <br />used by the City subject to the normal terms and conditions for real <br />estate transactions in Cuyahoga County, save that Riser Foods shall <br />pay all costs associated with the transfer of title of said property, <br />including recording fees, plat preparation, escrow fees and so forth. <br /> <br /> Section 5. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />.public in compliance with all legal requirements. <br /> <br /> Section 6. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br /> <br /> <br />
