ORDINANCE NO. 30-89 BY: Brown, Chinnock, Gallagher, George, Graham, Webdl lng AN EMERGENCY ORDINANCE authorizing the Director of Public works to sell certain property located in the right-of-way in front of Rego's Supermarket at 14013 Detroit Avenue, to Riser Foods. WHEREAS, the property located at 14013 Detroit Avenue in the public right-of-way shown in Parcel 1 and Parcel 2 attached hereto and incorporated by reference herein as Exhibits is presently part of the public right of way used as a sidewalk in front of Rego's Supermarket, and WHEREAS, Riser Foods desires to remodel the Rego's Supermarket at that location and to totally redesign the facade and store entrance, and WHEREAS, such renovation and remodeling will improvement to the area and enhance the neighborhood as well entire community, and be an as the WHEREAS, this change in design creates a condition and circumstance which demonstrates that the aforementioned property is no longer needed or suited for any municipal purpose., and WHEREAS, this ordinance constitutes an emergency in that it provides for the immediate preservation of the public health, safety and welfare; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council determines that the property described in Parcel 1 and Parcel 2 of the Exhibits attached hereto are no longer suited or needed for any municipal purpose and should be sold and that said sale is in the best interest of the City. Section 2. That this Council determines that the sale of the aforementioned property will further the interest of all of the citizens of this City. Section 3. That the Director of Public Works is hereby authorized to sell said property for a total sum of $2,500.00 to Riser Foods. Section 4. That the Director of Public Works is hereby authorized to enter into a contract prepared by the Director of Law and approved by the Director of Control for the sale of said property and that the conveyance will be in the usual form of quit claim deed used by the City subject to the normal terms and conditions for real estate transactions in Cuyahoga County, save that Riser Foods shall pay all costs associated with the transfer of title of said property, including recording fees, plat preparation, escrow fees and so forth. Section 5. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the .public in compliance with all legal requirements. Section 6. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members
