ORDINANCE NO. 49-89 BY: <br /> <br />Brown, Chinnock, Gallagher, <br />Gazzana, George, Graham, <br />Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor <br />ex-officio Director of Public Safety to issue a permit to Ms. Mary Nerad, <br />owner of Brigadoon Gifts, to conduct a sidewalk sale at 14813 Madison <br />Avenue on Thursday, July 20; Friday, July 21; and Saturday, July 22, 1989, <br />between the hours of 10:00 a.m and 5:00 p.m. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That notwithstanding the provision of Section <br />1667.17 of the Regional Building Code and the provision of Section 901.18 <br />of the Streets and Public Services Code of the Codified Ordinances of the <br />City of Lakewood, the Mayor, as ex-officio Director of Public Safety, be <br />and he is hereby authorized and directed to issue a permit to Ms. Mary <br />Nerad, owner of Brigadoon Gifts, to conduct a sidewalk sale at 14813 <br />Madison Avenue, in the City on Thursday, July 20; Friday, July 21; and <br />Saturday, July 22, 1989, between the hours of 10:00 a.m. and 5:00 p.m. No <br />more than fifty percent (50%) of the sidewalk width abutting participating <br />stores shall be occupied by displays, which occupied portion of the <br />sidewalk shall be that portion immediately adjacent to the principal <br />structure. <br /> <br /> Section 2. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this ordinance <br />were adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and of any of its committees that resulted <br />in such formal action were in meetings open to the public in compliance <br />with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds (2/3) of all <br />members of Council, it shall take effect and be in force immediately upon <br />its adoption and approval by the Mayor; otherwise, it shall take effect <br />and be in force after the earliest period allowed by law. <br /> <br />Approve~~_ .-)!.~ /~?_ <br /> <br />CLERK <br /> <br /> <br />
