PLACED ON FIRST READING 10~-16789. <br />PLACED ON SECOND READING I1/6~/89. <br /> <br />ORDINANCE NO. 65-89 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Gazzana, George, Graham <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor, <br />on behalf of the City of Lakewood, to enter into a Purchase Agreement <br />with Paul C. Neel, property owner, for the acquisition of a property <br />located in the City of Lakewood at 15538 Madison Avenue (Permanent <br />Parcel No. 313-27-10). <br /> WHEREAS, City Council has determined that it is in the best <br />interest of the City to acquire said property to be used for public <br />purpose, and <br /> <br /> WHEREAS, Paul C. Neel has indicated his willingness to <br />negotiate the sale of said property in a Purchase Agreement for the <br />consideration of $38,500, subject to final approval by this Council <br />pursuant to duly adopted ordinance and final acceptance by Paul C. <br />Neel. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare; now, therefore, <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That this Council finds and determines that the <br /> purchase of the property located at 15538 Madison Avenue is in the <br /> public interest and such purchase will serve a public purpose so that <br /> it contributes to the public health, safety and welfare. <br /> Section 2. That the Mayor, on behalf of the City of <br /> Lakewood, is hereby authorized and directed to enter into a Purchase <br /> Agreement for the acquisition of the property located at 15538 Madison <br /> Avenue (Permanent Parcel No. 313-27-10), and more specifically de- <br /> scribed in said Purchase Agreement, substantially in the form attached <br /> hereto and on file with the Clerk of Council. <br /> Section 3. It is found and determined that all formal <br /> actions of this Council concerning and relating to the passage of this <br /> ordinance were adopted in an open meeting of this Council, and that <br /> all such deliberations of this Council and of any of its committees <br /> that resulted in such formal action were in meetings open to the <br /> public in compliance with all legal requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an <br /> emergency measure for the reasons stated in the preamble hereof and <br /> provided it receives the affirmative vote of two-thirds of all members <br /> elected to Council, it shall take effect and be in force immediately <br /> upon its adoption and approval by the Mayor; otherwise, it shall take <br /> effect and be in force after the earliest period alloyed ~y law. <br /> <br /> Fre~iaent <br /> <br />Approved:~ ~ /~77 <br /> <br />Cl~rk of Council <br /> <br /> <br />
