ORDINANCE NO. 2-90' <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Public Works to <br />enter into a contract for the purchase of two (2} one-man operated, recycling <br />trucks. <br /> <br /> WHEREAS, Resolution No. 6415-89, adopted October 16, 1989, and <br />approved October 17, 1989, authorized and directed the Director of Public Works <br />to advertise for bids for two (2) one-man operated, recycling trucks, and <br /> <br /> WHEREAS, said equipment is necessary to expand the pilot recycling <br />program now in existence, and <br /> <br /> WHEREAS, the Board of Control has reviewed the bids received and <br />has determined that it is in the best interest of the City to award the <br />contract to Eagle International for the North Coast body bid as the lowest and <br />best bid meeting specifications, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of public health and welfare and for the usual <br />daily operation of a municipal department; now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be and he is hereby <br />authorized and directed to enter into a contract with Eagle International Truck <br />Sales, Inc., 13960 Brookpark Road, Cleveland, Ohio 44135 for the purchase of <br />two (2) one-man operated, recycling trucks. <br /> <br /> Section 2. The cost of $98,166.00 shall be paid with $4,166.00 <br />from the Capital Improvement Fund and $94,000.00 from the State Recycling <br />Grant. <br /> <br /> Section 3. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council and of any of its committees that <br />resulted in such formal action were in meetings open to the public, in compli- <br />ance with all legal requirements. <br /> <br />Section 4. That this ordinance is hereby declared to be an emer- <br />gency measure for reasons stated in the preamble hereof and provided it <br />receives the affirmative vote of two-thirds of all members elected to Council, <br />it shall take effect and be in force immediately upon its ado~i~oval <br />by the Mayor; otherwise it shall take effect and ' st <br />period allowed by law. <br /> <br />Adopted:~ ;~, /~'~ <br /> ~ ent <br /> <br /> Clerk <br /> <br /> <br />
