ORDINANCE NO. 18-90 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br />George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor <br />ex-officio Director of Public Safety to advertise for the sale of one {1) <br />1971 Young, Pierce-Pittman 85-foot Snorkel truck and miscellaneous equipment <br />for the Division of Fire, Department of Public Safety. <br /> <br /> WHEREAS, Ohio Revised Code Section 721.01 provides that municipal <br />corporations have special power to sell personal property, and Ohio Revised <br />Code Section 721.15 further provides that personal property not needed for <br />municipal purposes may be sold when authorized by ordinance of the <br />legislative authority, and <br /> <br /> WHEREAS, the 1971 Young, Pierce-Pittman 85-foot Snorkel truck, <br />together with ground ladders and miscellaneous equipment, has been replaced <br />with new equipment, is no longer needed for municipal purposes and should be <br />sold, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public safety and welfare and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. This Council hereby determines that the 1971 Young, <br />Pierce-Pittman 85-foot Snorkel truck of the Division of Fire has been <br />replaced by new equipment and is no longer needed for municipal purposes. <br /> <br /> Section 2. That the Mayor ex-officio Director of the Department of <br />Public Safety be and he is hereby authorized to advertise, pursuant to law, <br />for the sale of one (1) 1971 Young, Pierce-Pittman 85-foot Snorkel truck, <br />including ground ladders and miscellaneous equipment, and enter into a <br />contract for the sale of said vehicle, and to accept the best bid therefor, <br />or to reject all such bids in favor of the trade-in amount offered by the <br />successful bidder on the acquisition, pursuant to ordinance, of the fire <br />vehicle replacing this vehicle, whichever is most beneficial to the-City. <br /> <br /> Section 3. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations <br />of this Council and of any of its committees that resulted in such formal <br />action, were in meetings open to the public, in compliance with all legal <br />requirements. <br /> <br /> Section 4.
