COND,:g~G 7/16/90. 54-90 BY: Boscia, Gallagher, Gazzana, George, Graham, Roth,Smith AN EMERGENCY ORDINANCE· to amend Section 1779.02 of the Sanitary Code of the Codified Ordinances of the City of Lakewood by the enactment of new Section 1779.02. WHEREAS, repeated violations of the same ordinance indicate unreasonable and intentional action by such individuals, and WHEREAS, repeated violators have notice of the requirements of the ordinances of the City, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That 1779.02 of the Sanitary Code of the Codified Ordinances of the City of Lakewood now reading as follows: 1779.02 ABATEMENT. No owner, lessee or occupant of any premises in or upon which any condition prohibited in Section 1779.01 exists, shall fail or refuse to abate the same within seven days after being notified to do so, as hereinafter provided. is hereby amended to read as follows: 1779.02 ABATEMENT. (a) No owner, lessee or occupant of any premises in or upon which any condition prohibited in Sec- tion 1779.01 exists, shall fail or refuse to abate the same within seven days after being notified to do so, as hereinafter provided. (b) In · the event of a second citation of a violation of any provision of this Section within six (6) calendar months of a~ previous citation, the notice requirement under this Section shall be 24 hours for correction as opposed to the seven (7) days required under subsection (a) above. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 3.
