COND,:g~G 7/16/90. <br /> <br /> 54-90 BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth,Smith <br /> AN EMERGENCY ORDINANCE· to amend Section 1779.02 of the <br />Sanitary Code of the Codified Ordinances of the City of Lakewood by <br />the enactment of new Section 1779.02. <br /> WHEREAS, repeated violations of the same ordinance indicate <br />unreasonable and intentional action by such individuals, and <br /> WHEREAS, repeated violators have notice of the requirements <br />of the ordinances of the City, and <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal <br />department; now, therefore, <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That 1779.02 of the Sanitary Code of the <br /> Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />1779.02 ABATEMENT. <br /> <br />No owner, lessee or occupant of any premises in or <br />upon which any condition prohibited in Section <br />1779.01 exists, shall fail or refuse to abate the <br />same within seven days after being notified to do <br />so, as hereinafter provided. <br /> <br />is hereby amended to read as follows: <br /> <br /> 1779.02 ABATEMENT. <br /> (a) No owner, lessee or occupant of any premises <br /> in or upon which any condition prohibited in Sec- <br /> tion 1779.01 exists, shall fail or refuse to abate <br /> the same within seven days after being notified to <br /> do so, as hereinafter provided. <br /> (b) In · the event of a second citation of a <br /> violation of any provision of this Section within <br /> six (6) calendar months of a~ previous citation, <br /> the notice requirement under this Section shall be <br /> 24 hours for correction as opposed to the seven (7) <br /> days required under subsection (a) above. <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> Section 3.
