PLACED ON FIRST READING ON 6/18/90. <br />PLACED ON SECOND READ~N,G ,ON 7/16/90. <br /> <br />ORDINANCE NO. 55-90 BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> AN EMERGENCY ORDINANCE to amend Chapter 1775 of the Sanitary <br />Code of the Codified Ordinances of the City of Lakewood by the <br />enactment of new Section 1775.09. <br /> <br /> WHEREAS, repeated violations of the same ordinance indicate <br />unreasonable and intentional action by such individuals, and <br /> <br /> WHEREAS, repeated violators have notice of the requirements <br />of the ordinances of the City, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Chapter 1775 of the Sanitary Code of the <br />Codified Ordinances of the City of Lakewood be and the same is hereby <br />amended by the enactment of new Section 1775.09 to read as follows: <br /> <br />1775.09 NOTICE TO REPEAT OFFENDERS. <br /> <br />In the event of a second citation of a violation of <br />any provision of this Section within six (6) <br />calendar months of a previous citation, the notice <br />requirement under this Section shall be 24 hours <br />for correction as opposed to the five (5) days <br />required under subsection 1775.07 above. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and. relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earlies~d by law. <br /> <br /> CLERK <br /> <br />Approved:~~ ~ ~i /7/~ <br /> <br /> <br />
