ORDINANCE NO. 56-90 <br /> <br />BY: <br /> <br />F~nsni.., Gallagher, George, <br />Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 565.14 of the <br />General Offenses Code of the Codified Ordinances of the City of <br />Lakewood regulating the preservation and removal of trees and shrubs <br />on private property. <br /> <br /> WHEt{EAS, the neglected or damaged condition of trees and <br />shrubs on private property may constitute a threat to the public <br />health, safety and welfare and/or a public nuisance , and <br /> <br /> WHEREAS, from to time it may be necessary for the City to <br />act to preserve our important greenery, abate public nuisances and <br />abate threats to public health, safety and welfare, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />of the <br />follows: <br /> <br /> Section 1. That Section 565.15 of the General Offenses Code <br />Codified Ordinances of the City of Lakewood, now reading as <br /> <br />565.14 <br /> <br />PRESERVATION AND REMOVAL OF TREES AND <br />SHRUBS ON PRIVATE PROPERTY. <br /> <br />The Director of Public Works is hereby authorized <br />to cause to be inspected any tree or shrub within <br />the City reported or supposed to be infected or <br />infested by any parasite or insect pest. If, upon <br />such inspection, the Director determines that such <br />tree or shrub is infected or infested by any <br />parasite or insect pest, he shall, if such tree is <br />located on private property, immediately serve upon <br />the owner of such property a written notice that <br />such tree or shrub is infected or infested and that <br />the same must be treated or removed within five <br />days of the service of such notice. If the owner <br />cannot be found, a copy of the such notice shall be <br />posted upon such infected to infested tree or <br />shrub. If such tree or shrub is not treated or <br />removed within seven days after the service or <br />posting of such notice, the Director shall cause <br />such tree to be removed and burned. The cost of <br />such treating or remOving shall be assessed against <br />such owner in the same manner as in other cases of <br />the abatement of nuisances, and in default of <br />payment shall be assessed against the property on <br />which such tree or shrub is located. <br /> <br />is hereby amended to read as follows: <br /> <br />565.14 <br /> <br />PRESERVATION AND REMOVAL OF TREES AND <br />SHRUBS ON PRIVATE PROPERTY. <br /> <br />The Director of Public Works is hereby authorized <br />to cause to be inspected any tree or shrub in the <br />City reported or supposed to be in~ected, infested <br />by any parasite or insect pestilor in any way <br />reported or supposed to be a m~ace to public <br />property, public health, public safety, public <br />welfare or a public nuisance~ If, upon such <br />inspection, the Director determfnes that such tree <br />or shrub is infected, infested or a menace to <br /> <br />1 <br /> <br /> <br />
