ORDINANCE NO. 56-90 BY: F~nsni.., Gallagher, George, Graham, Roth, Smith AN EMERGENCY ORDINANCE to amend Section 565.14 of the General Offenses Code of the Codified Ordinances of the City of Lakewood regulating the preservation and removal of trees and shrubs on private property. WHEt{EAS, the neglected or damaged condition of trees and shrubs on private property may constitute a threat to the public health, safety and welfare and/or a public nuisance , and WHEREAS, from to time it may be necessary for the City to act to preserve our important greenery, abate public nuisances and abate threats to public health, safety and welfare, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: of the follows: Section 1. That Section 565.15 of the General Offenses Code Codified Ordinances of the City of Lakewood, now reading as 565.14 PRESERVATION AND REMOVAL OF TREES AND SHRUBS ON PRIVATE PROPERTY. The Director of Public Works is hereby authorized to cause to be inspected any tree or shrub within the City reported or supposed to be infected or infested by any parasite or insect pest. If, upon such inspection, the Director determines that such tree or shrub is infected or infested by any parasite or insect pest, he shall, if such tree is located on private property, immediately serve upon the owner of such property a written notice that such tree or shrub is infected or infested and that the same must be treated or removed within five days of the service of such notice. If the owner cannot be found, a copy of the such notice shall be posted upon such infected to infested tree or shrub. If such tree or shrub is not treated or removed within seven days after the service or posting of such notice, the Director shall cause such tree to be removed and burned. The cost of such treating or remOving shall be assessed against such owner in the same manner as in other cases of the abatement of nuisances, and in default of payment shall be assessed against the property on which such tree or shrub is located. is hereby amended to read as follows: 565.14 PRESERVATION AND REMOVAL OF TREES AND SHRUBS ON PRIVATE PROPERTY.
