BY: Boscia, Gallagher, Gazzana, 'George, Graham, Roth, Smith AN Si~x~AGENCY ORDINANCE to amend Section 351.16 of the Traffic ~Code of the Codified Ordinances of the City of Lakewood to repeal and amend Section 351.16 and enacting new Section 351.16 relating to displaying autos for sale and advertising. WHEREAS, it is desirable that the City streets and public right of ways not be used for displaying automobiles or other vehicles for sale or advertising purposes, except as otherwise provided for in the Codified Ordinances, and WHEREAS, it is necessary from time to time to revise the Codified Ordinances for the purpose of clarification, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 351.16 of the Traffic Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 351.16 DISPLAYING AUTOS FOR SALE; ADVERTISING. No person shall stand or p ark a vehicle on any street in the City when any such vehicle is displayed for sale or for the primary purpose of displaying advertising. shall be and the same is hereby repealed. Section 2. That Section 351.16 of the Traffic COde of the Codified Ordinances of the City of Lakewood be and the same is hereby supplemented and amended by enacting new Section 351.16 to read as follows: 351.16 DISPLAYING AUTOS FOR SALE; ADVERTISING. (a) No person shall stand or park a vehicle on any street or in any Public right of way in the City for the primary purpose of displaying such vehicle for sale or for the primary purpose of displaying advertising. (b) This section shall not apply to the placing of signage on a personal vehicle advertising that vehicle for sale, so long as the signage is placed inside the vehicle, and does not significantly obstruct the view of the driver so as to interfere with the safe operation of such vehicle and so long as such vehicle is not parked or stood upon a public street on the public right of way for the primary purpose of advertising that vehicle for sale. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to. the public in compliance with all legal requirements.
