PLACED ON FIRST READING AND REFERRED TO <br />TRAFFIC & s~FBTY COMMITTEE ON 12/17/90 <br /> PLACED ON SECOND READING on 4/1/91. <br /> <br />ORDINANCE NO. 91-90 <br /> <br />BY: 'G~llagher, F~rge, 'Graham, -:~. ~oth, ,Smith'~ "_,_ . <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 313.10 of the Traffic Code <br />of Codified Ordinances of the City of Lakewood by enact~ing a restriction to <br />a right turn against a steady red signal during the hours of 8:00 A.M. to <br />4:00 P.M. Monday through Friday, in all four (4) directions, at the Delaware <br />Avenue and Woodward Avenue intersection. <br /> <br /> WHEREAS, concern exists concerning safety of school children <br />crossing Delaware Avenue and Woodward Avenue during school hours, and <br /> <br /> WHEREAS, it has been determined that prohibitions during certain <br />hours of a right turn against a steady red signal would contribute to the <br />safety of Lakewood school children, remove a potential hazard and deter <br />continued violations of existing statutes, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare; now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 313.10 of the Traffic Code of the Codified <br />Ordinances of the City of Lakewood now reading as follows: <br /> <br />313.10 PROHIBITED TURNS ON RED SIGNALS. <br /> <br /> Pursuant to the provisions of Section 313.03 (c)(5), it is hereby <br />determined that the following intersections are used by a substantial number <br />of school children and are a hazard to such school children and, therefore, <br />a right turn against a steady red signal is hereby prohibited between the <br />hours of 8:00 a.m. and 4:00 p.m., Monday through Friday, at the following <br />intersections, upon the posting and installation of the proper signs giving <br />notice thereof: <br /> <br />ii) ~ela~are Avenue. <br /> (1) Woodward Avenue <br /> <br />northbound only <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />313.10 PROHIBITED TURNS ON RED SIGNALS. <br /> <br /> Pursuant to the provisions of Section 313.03 (c) (5), it is hereby <br />determined that the following intersections are used by a substantial number <br />of school children and are a hazard to such school children and, therefore, <br />a right turn against a steady red signal is hereby prohibited between the <br />hours of 8:00 a.m. and 4:00 p.m., Monday through Friday, at the following <br />intersections, upon the posting and installation of the proper signs giving <br />notice thereof: <br /> <br />ii) 6elaware Avenue· <br /> (1) Woodward Avenue <br /> <br />all four (4) directions <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations <br />of this Council and of any of its committees that resulted in such formal <br />action were in meetings open to the public in compliance, with all legal <br />requirements. <br /> <br /> <br />
