AN EMERGENCY ORDINANCE to amend Section 313.10 of the Traffic Code of Codified Ordinances of the City of Lakewood by enact~ing a restriction to a right turn against a steady red signal during the hours of 8:00 A.M. to 4:00 P.M. Monday through Friday, in all four (4) directions, at the Delaware Avenue and Woodward Avenue intersection. WHEREAS, concern exists concerning safety of school children crossing Delaware Avenue and Woodward Avenue during school hours, and WHEREAS, it has been determined that prohibitions during certain hours of a right turn against a steady red signal would contribute to the safety of Lakewood school children, remove a potential hazard and deter continued violations of existing statutes, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 313.10 of the Traffic Code of the Codified Ordinances of the City of Lakewood now reading as follows: 313.10 PROHIBITED TURNS ON RED SIGNALS. Pursuant to the provisions of Section 313.03 (c)(5), it is hereby determined that the following intersections are used by a substantial number of school children and are a hazard to such school children and, therefore, a right turn against a steady red signal is hereby prohibited between the hours of 8:00 a.m. and 4:00 p.m., Monday through Friday, at the following intersections, upon the posting and installation of the proper signs giving notice thereof: ii) ~ela~are Avenue. (1) Woodward Avenue northbound only be and the same is hereby amended to read as follows: 313.10 PROHIBITED TURNS ON RED SIGNALS. Pursuant to the provisions of Section 313.03 (c) (5), it is hereby determined that the following intersections are used by a substantial number of school children and are a hazard to such school children and, therefore, a right turn against a steady red signal is hereby prohibited between the hours of 8:00 a.m. and 4:00 p.m., Monday through Friday, at the following intersections, upon the posting and installation of the proper signs giving notice thereof: ii) 6elaware Avenue· (1) Woodward Avenue all four (4) directions Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance, with all legal requirements.
