· ORDINANCE NO. 101-91 BY: Gallagher, Gazzana, George, <br /> ',' Graham, Roth, Smith <br /> AN EMERGENCY'ORDINANCE, authOrizing and directing the ~Director <br />of Public Works to enter into a contract with Ohio Bell Telephone Company <br />to provide the necessary labOr for the/ installation of underground <br />communication and alarm cables in existing condUit without competitive <br />bidding. . <br /> <br /> WHEREAS, it is cost-effective and in the best interests of the <br />City to award a contract for installation of underground communication <br />cables without competitive bidding~ and <br /> <br /> WHEREAS, a proposal has been received from Ohio Bell Telephone <br />Company to provide the necessary labor at the lowest and most reasonable <br />cost; and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure for <br /> the immediate preservation of the public property, health and safety and <br /> to insure the daily operation of a City Department as installation of <br /> these communication and alarm cables is necessary to maintain the <br /> municipal fire alarm system during the construction of the Lakewood City <br /> Center Project and relocation of Fire Station Number i; now, therefore, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. -It is hereby determined that it is <br />cost-effective-and in the.best interests of the City to accept the <br />proposal to install these underground cables from Ohio Bell Telephone <br />Company, 45 Erieview Plaza, Cleveland, Oh 44114 without competitive <br />bidding; therefore, the Director of Public Works on behalf of the City of <br />Lakewood be and he is hereby authorized and directed to enter into a <br />written contract with Ohio Bell Telephone Company in accordance with of <br />its proposal dated November 26, 1991, at a cost of $19,200 said <br />written contract to be substantially in the form of Exhibit "A" with such <br />additional.provisions as are acceptable to the.Director of Law to protect <br />the public interest. <br /> <br /> Section 2. That 'the .Acting Director or Director of Finance be <br />and he is hereby authorized to draw checks upon the City depositories for <br />the amounts appropriated in this ordinance whenever claims are properly <br />presented. <br /> <br /> Section 3. That pursuant to the conditions of the <br />aforementioned written contract, Council hereby formally approves the <br />proposal of installation of underground cables hereinabove described, <br />inclUding the terms and conditions set forth therein and approves and <br />ratifies the actions of the Director of Public Works as of this date and <br />authorize the Acting Finance Director or Finance Director to expend the <br />necessary funds to complete the contract. <br /> <br /> Section 3. It is found and determined that all formal .actions <br />of this Council concerning and relating to the passage of this ordinance <br />were adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and of any of its committees that resulted <br />in such formal action were in meetings open to the public in compliance <br />with all legal requirements including the City's Charter and Codified <br />Ordinances. <br /> <br /> Section 4.
