ORDINANCE NO. 25-91 BY: Gallagher, George, Graham, ~ Roth, Smith AN EMERGENCY ORDINANCE amending Sections 1321.01(a), 1321.03, and 1323.03 of the Building Code regarding fees for licens- ing of electricians, plumbing and heating and/or air conditioning contractors and registration of contractors. WHEREAS, the fee for a contractor's license for persons engaging in heating and air conditioning, electrical or plumbing work in Chapter 1323 was last amended in 1979, and WHEREAS, the cost to the City of administering the contrac- tor licensing and registration programs has increased substantially since 1979, and WHEREAS, the efficient and effective operation of the licensing and registration programs is essential to the maintenance and preservation of the City's valued housing stock, and WHEREAS, the present contractor licensing fee ordinance unfairly distinguishes between H.V.A.C., plumbing and electrical contractors who repair and those who install new equipment and be- tween H.V.A.C., plumbing and electrical contractors as opposed to general contractors, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal depart- ment;now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 1321.01(a) of the Building Code the Codified Ordinances of the City of Lakewood, now reading as follows: 1321.01 LICENSING REQUIREMENT. (a) No person, corporation, partnership, firm or other business association shall, acting in the capacity of a contractor, engage in heating and/or air conditioning work, electrical work or plumbing work, for which a permit is required without first obtaining a license for each trade from the Build- ing Commissioner. shall be and the same is hereby amended to read as follows: 1321.01 LICENSING REQUIREMENT. (a) No person, corporation, partnership, firm or other business association shall, acting in the capacity of a contractor, engage in heating and/or air conditioning work, electrical work or plumbing work, without first obtaining a license for each trade from the Building Commissioner. . Section 2. That Section 1321.03 of the Building Code of Codified Ordinances, now reading as follows: · ' . <" The license shall be valid for the calendar year in which issued and shall be rehewed annually thereafter. A fee of twenty-five dollars (~25.00) shall be paid at the time of the application and at each renewal thereafter.
