ORDINANCE NO. 63-91 BY: Boscia, Gallagher, 'Gazzana, George, Graham, Roth, Smith AN EMERGENCY ORDINANCE· to make appropriations from the Capitol Improvement Fund for the purchase of one (1) yard waste tub grinder. WHEREAS, an emergency exists for the immediate preservation of the public property, health' and safety and to provide for the usual daily operation of municipal departments, and WHEREAS, under-HB-592 it is required by law that cities remove all yard wastes from the waste stream, and WHEREAS, the- West Shore Council of Governments (WSCOG) has received bids for this purchase in a manner according to law, and WHEREAS, it will be cost effective for the City of Lakewood to process and dispose of all yard wastes with the other member cities of the West Shore Council of Governments; now, therefore: BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That there be appropriated from the Capitol Improve- ment Funds: Yard Waste Tub Grinder $41,585.00 Section 2. That the Director of 'Finance be and is hereby authorized to draw checks upon 'the City-depositories for the amounts appropriated in this ordinance whenever claims are .presented, properly approved, by the head of the Department 'For-which the indebtedness is incurred, provided the President of Council shall approve all claims of the City'Council. Section 3. In accordance with Article III, Section 14, of the Charten of the-City of Lakewood, Council hereby determines that the manner of giving notice of the passage of this ordinance is to be by posting copies hereof for a period of not less than fifteen (15) days, in not less than five (5) of the most public'places in the City, which places have been determined by Council in Ordinance No. 55-59. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council and of any of its committees that resulted in such formal actions were in meetings open to the public in compliance with all legal requirements. Section 5. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble, and provided it receives the affirmative vote of two-thirds (2/3) of all members elected to Council, it·'Shall take effect·and be in force immediately upon its adoption and approval by the Mayor.
