ORDINANCE, <br />Mayor, for and on behalf of the <br />dedication and conveyance of certain improved land <br />11709 Madison Avenue, in the City of-Lakewood. <br /> <br /> By: Boscia, Gallagher~ Gazzana, <br /> George, Graham,, Roth, Smith <br /> <br />authorizing and directing'the <br />City of Lakewood to accept a <br /> situated at <br /> <br /> WHEREAS, UCAR Carbon Company incorporated, a Delaware <br />Corporation having offices at 39 Old Ridgebury Road, Danbury <br />Connecticut 06817, holds fee title to a certain improved parcel of <br />land situated at 11709 Madison Avenue in the City of Lakewood, <br />Cuyahoga County, State of Ohio. <br /> <br /> WHEREAS, UCAR Carbon Company Incorporated, has advised <br />the City of its intent to dedicate and convey titie to said parcel <br />of land for one dollar ($1) and'other valuable consideration. <br /> <br /> WHEREAS, this COuncil .determines that it is in the best <br />interest of the City to accept such parcel of land,-and <br /> <br /> WHEREAS, this Council.by two-thirds vote of the members <br />elected thereto determines that this ordinance is an emergency <br />measure which is necessary for the immediate preservation of the <br />public peace, property, .health and safety. <br /> <br />BE IT ORDAINED'BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. 'That the Mayor on behalf of the City of <br />Lakewood be and he is hereby authorized and directed to accept the <br />dedication and conveyance of a deedfor the following described <br />premises located at 11709 Madison Avenue and described in Exhibit <br />"A" attached hereto and incorporated by reference herein, said <br />Purchase Agreement to be substantially in the form of Exhibit "A" <br />with such additional ~provisions as are acceptable to the <br />Director of Law to protect the public interest. <br /> <br /> seCtion 2.. That pursuant' to the conditions of the <br /> aforementioned Purchase Agreement', Council hereby formally <br /> approves the purchase of said property hereinabove described, <br /> including the terms and conditions ~set therein and approves and <br /> ratifies the actions of the Mayor as of this date and authorize <br /> the Finance Director or Acting Finance Director to expend the <br />'necessary funds to complete the purchase. <br /> <br /> Section 3. It is found and determined that all formal action <br />of this Council concerning and relating to the passage of this <br />ordinance were adOpted in an open meeting of this Council., and <br />that all such deliberations of this Council and of any of its <br />committees that resulted in suCh formal action, were in meetings <br />open to the public, in compliance with all legal requirements. <br /> <br />Approved: <br /> <br /> Section 4.
