ORDINANCE NO. 23-92 BY: Boscia, Gallagher, George, Gibbons, Roth, Seelie, Smith AN EMERGENCY ORDINANCE, authorizing and directing the Mayor, on behalf of the City of Lakewood, to enter into a Purchase Agreement with Linda and Raymond Gruss, for the acquisition of property located at 1361 Giel Avenue, in the City of Lakewood. WHEREAS, the Community Development Corporation of Lakewood purchased this foreclosed property from the U.S. Department of Housing and Urban Development. While preparing the paperwork, HUD inadvertently inserted the City of Lakewood as the purchaser, and WHEREAS, the Community Development Corporation of Lakewood in accordance with a HUD approved program has found a qualified Buyer who was selected from a lottery and the sale of the property has been unanimously approved by the Community Development Corporation of Lakewood, and WHEREAS,. the price was determined before the lottery and is non-negotiable, and WHEREAS, Linda and Raymond GrUss, the Community Development Corporation of Lakewood's selected Buyer, have agreed to buy the property from the City for One Hundred and Eighteen Thousand ($118,000) Dollars, with financing by the Community Development Corporation of Lakewood, subject to final approval by Council pursuant to a duly adopted ordinance and final acceptance of the agreement, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, for the reason that the property remains unoccupied and no funds can be returned to the Community Development Corporation of Lakewood for use by other lower and moderate income persons until title can be transferred; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor on behalf of the City of Lakewood be and he is hereby authorized and directed to enter into a Purchase Agreement with Linda and Raymond Gruss, for the sale of the property located adjacent to 1361 Giel Avenue and described in Exhibit "A" attached hereto and incorporated by reference herein, said Purchase Agreement to be substantially in the form of Exhibit "B" with such additional provisions as are acceptable to the Department of Law to protect the public interest. Section 2. That pursuant t.o the conditions of the aforementioned Purchase Agreement, Council hereby formally approves the sale of said property hereinabove described, including the terms and conditions set forth therein and approves and ratifies the actions of the Mayor as of this date. Section 3. It is found and determined that .all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
