ORDINANCE NO. 24~92 BY: Boscia, Gallagher, George, Gibbons, Roth, Seelie, Smith AN EMERGENCY ORDINANCE determining to prOceed with the improvement of an easement of the City of Lakewood by constructing thereon a breakwall with concrete modules,-fill and-end return. WHEREAS, this Council passed Resolution No. 6637-91 on September 16, 1991, declaring it necessary to improve an easement of the City of Lakewood by-constructing thereon a breakwall with concrete modules, fill and end return~ and WHEREAS,'the 'Board of Revision of Assessments has filed its Final Report with ~this Council; and WHEREAS, this Council by two-thirds vote of the members elected thereto determines that this Ordinance is an emergency measure which is necessary for the i~nediate preservation of the public peace, property, health and safety and for the further reason that the improvement herein provided for is immediately necessary to protect the property and health of the residents of the City which are endangered by the continuing erosion of the Lake Erie shoreline which undermines houses, water lines, Sanitary sewers and streets; ~ NOW~ THEREFORE, BE IT ORDAINED by the'Councii of the City of Lakewood, Cuyahoga County, State of Ohio: Section 1. It is hereby determined to proceed with the improvement in the City of.Lakewood, Ohio 'of an approximately twenty (20) foot wide easement with its northern boundary located approximately twenty (20) feet north of the currently existing southerly shore of Lake Erie in an area now submerged lands but' formerly a Part of the lots on the northerly side of Edgewater Drive from the easterly line of property now or formerly owned by the Unit Owners of the Lake House Condominium.as tenants in common, now or formerly known as 'the Permanent Parcel Nos. listed on Exhibit A attached hereto and on the tax ~list and maps of the Cuyahoga County and assigned as its address 11850 Edgewater Drive, westerly approximately 330 feet to the 'westerly line of said property. Section 2. Said improvement shall be made in accordance with the provisions of ResOlution No. 6637-9i passed on September 16, 1991, and with the plans, specifications, estimate of cost and profiles heretofore approved and'now on file in the office of the Clerk of this Council. Section 3. The portion of the cost provided in the above-mentioned Resolution of Necessity to be assessed shall be assessed in the manner and the number of installments provided in said Res$1ution and on the lots and lands described therein. Section 4o The estimated assessments heretofore prepared and filed in the office of the Clerk of this Council and approved by the Board of Revision of Assessments in its Final Report to the Council be and the same are hereby adopted. Section 5. The Clerk of this Council is hereby directed to deliver a certified copy of this Ordinance to the County Auditor within fifteen (15) days after its passage° Section 6. The Director of Public Works 'is hereby authorized and directed as soon as the funds therefor are available to make and execute a contract for said improvement with the lowest
