ORDINANCE NO. <br /> <br />24~92 <br /> <br /> BY: Boscia, Gallagher, <br />George, Gibbons, Roth, Seelie, <br />Smith <br /> <br /> AN EMERGENCY ORDINANCE determining to prOceed with the <br />improvement of an easement of the City of Lakewood by constructing <br />thereon a breakwall with concrete modules,-fill and-end return. <br /> <br /> WHEREAS, this Council passed Resolution No. 6637-91 on <br />September 16, 1991, declaring it necessary to improve an easement <br />of the City of Lakewood by-constructing thereon a breakwall with <br />concrete modules, fill and end return~ and <br /> <br /> WHEREAS,'the 'Board of Revision of Assessments has filed <br />its Final Report with ~this Council; and <br /> <br /> WHEREAS, this Council by two-thirds vote of the members <br />elected thereto determines that this Ordinance is an emergency <br />measure which is necessary for the i~nediate preservation of the <br />public peace, property, health and safety and for the further <br />reason that the improvement herein provided for is immediately <br />necessary to protect the property and health of the residents of <br />the City which are endangered by the continuing erosion of the Lake <br />Erie shoreline which undermines houses, water lines, Sanitary <br />sewers and streets; ~ <br /> <br /> NOW~ THEREFORE, BE IT ORDAINED by the'Councii of the City <br />of Lakewood, Cuyahoga County, State of Ohio: <br /> <br /> Section 1. It is hereby determined to proceed with the <br />improvement in the City of.Lakewood, Ohio 'of an approximately <br />twenty (20) foot wide easement with its northern boundary located <br />approximately twenty (20) feet north of the currently existing <br />southerly shore of Lake Erie in an area now submerged lands but' <br />formerly a Part of the lots on the northerly side of Edgewater <br />Drive from the easterly line of property now or formerly owned by <br />the Unit Owners of the Lake House Condominium.as tenants in common, <br />now or formerly known as 'the Permanent Parcel Nos. listed on <br />Exhibit A attached hereto and on the tax ~list and maps of the <br />Cuyahoga County and assigned as its address 11850 Edgewater Drive, <br />westerly approximately 330 feet to the 'westerly line of said <br />property. <br /> <br /> Section 2. Said improvement shall be made in accordance <br />with the provisions of ResOlution No. 6637-9i passed on <br />September 16, 1991, and with the plans, specifications, estimate of <br />cost and profiles heretofore approved and'now on file in the office <br />of the Clerk of this Council. <br /> <br /> Section 3. The portion of the cost provided in the <br />above-mentioned Resolution of Necessity to be assessed shall be <br />assessed in the manner and the number of installments provided in <br />said Res$1ution and on the lots and lands described therein. <br /> <br /> Section 4o The estimated assessments heretofore prepared <br />and filed in the office of the Clerk of this Council and approved <br />by the Board of Revision of Assessments in its Final Report to the <br />Council be and the same are hereby adopted. <br /> <br /> Section 5. The Clerk of this Council is hereby directed <br />to deliver a certified copy of this Ordinance to the County Auditor <br />within fifteen (15) days after its passage° <br /> <br /> Section 6. The Director of Public Works 'is hereby <br />authorized and directed as soon as the funds therefor are available <br />to make and execute a contract for said improvement with the lowest <br /> <br /> <br />
