ORDINANCE NO. <br /> <br />27-92 BY: <br /> <br />Boscia, Gallagher, George, <br />Gibbons, Roth, Seelie, Smit] <br /> <br /> AN EMERGENCY ORDINANCE supplementing and amending Chapter <br />1329 of the Building Code of the Codified Ordinances of the City of <br />Lakewood relating to the regulation of signs by: amending paragraph <br />(d), and adding new paragraphs (e) and (f) to Section 1329.12. <br /> <br /> WHEREAS, the City of Lakewood is a Home Rule Municipality <br />and by the authority of the Constitution of the State of Ohio, is <br />authorized to regulate signage for the protection of the public <br />health, safety and welfare, and <br /> <br /> WHEREAS, standards for the regulation of signs ~hall promote <br />and maintain the high value of residential and commercial districts in <br />the City of Lakewood, and <br /> <br /> WHEREAS, standards'for the regulation of signs shall impr~ve <br />the appearance of commercial areas by the design of signs which are <br />aesthetically harmonious with surrounding properties and the overall <br />urban design of the City, and <br /> <br /> WHEREAS, certain amendments to the existing Sign Code, <br />Chapter 1329 of Codified Ordinances, are necessary by reason of <br />changes of related sections in other parts of the Codified Ordinances, <br />practical considerations based upon experience in administration of <br />the Code. <br /> <br /> WHEREAS, this Chapter constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare of the citizens of the City of Lakewood, and for'the <br />further reason that such standards should be established at the <br />earliest possible time; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />follows: <br /> <br />Section 1. That existing Section 1329.12(d) now reading as <br /> <br />(d) All signs shall be approved by the Board of Building <br />Standards; provided, however, the Building Commissioner is <br />authorized to issue permits for temporary signs and may <br />issue a sign painting permit if in the opinion of the <br />Building Commissioner, the painting of the sign would be <br />compatable with the existing building and surrounding <br />neighborhood. The Building Commissioner may not issue more <br />than four permits for temporary signs to an applicant <br />relative to a specific sign per year. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />(d) All signs shall be approved by the Board of Building <br />Standards; provided, however, the Building Commissioner is <br />authorized to issue canopy, wall, window and awning signs, <br />as defined in 1329.03(c)(1)(7)(8) and (9), without <br />additional Board approval for any structure that has been <br />previously reviewed by the Board of Building <br />Standards/Architectural Review Board and a building <br />standard for uniform signage has been established <br />for two or more retail, mercantile or other business <br />occupancies and the new signage is in conformity with the <br />general plan for the building and complies with all other <br />applicable sections of this ordinance. <br /> <br />(e) The' Building Commissioner may issue permits for. <br />temporary signs, as defined in 1329.03(b)(10), not to exceed <br />four permits to an applicant relative to a specific sign per <br />twelve-month period. <br /> <br />(f) The repainting of existing signs the same color, size <br />and message shall be considered maintenance and no permit <br />shall be required. <br /> <br />1 <br /> <br /> <br />
