,~ ORDINANCE NO. 66-92 BY: Boscia, Gallagher, Gèör~e, Gibbons, Roth, Seelie, Smith AN EMERGENCY ORDINANCE to amend the Administrative Code of the Codified Ordinances of the city of Lakewood to enact new Sectio~ 101.09 authorizing the Civil Service Commission to provide for com+ petitive promotional examinations consisting of one or more tests. ' WHER,EAS, the City of Lakewo.od is a charter- municipality with authority to exercise all powers of local self-government pursu~ ant to Article XVIII, Section 3 of th~ Ohiö Constitution, and WHEREAS, the city Charter provides for a civil servicJ Commission and authorizes said Commission to make, promulgate, pre- scribe and enforce rules for the promotion of employees in the clas~ sified service in Article XIII, section 4 of the city Charter, and WHEREAS, the rules of the Lakewood civil Service Commission provide for a combination of tests for promotion in the Civil Serv- ice, which tests may be written)oral,'physical, demonstration of skill, or evaluation of training and experience designed to fairly test the relative capacity of the persons examined to discharge the particular duties of the positions to which they are seeking promo- tion, and WHEREAS, a recent decision of the Eighth District Court of Appeals has struck down another cityls police promotional tests because neither the' city charter nor specific ordinance authorized the civil Service Commission to deviate from state code which limits promotional examinations to competitive written tests, and WHEREAS, the City of Lakewood Civil Service Commission has had long standing favorable experience with a combination of tests, including nort-written portions and has promotional examinations currently scheduled for the Police Department, and WHEREAS, this ordinance constitutes an emergency measur~ providing for the immediat~ preservation of the public health, safety and welfare, and for the usual daily òperation of a municipal depart~ ment for the reasons that tests scheduled for the summer will have to be redesigned then rescheduled if this measure is not enacted on an emergency basis¡now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. Ordinances of the city Section 101.09 to read That the Administrative Code of the Codified of Lakewood be amended by the enactment of ne~ as follows: 101.09 CIVIL SERVICE COMMISSION PROMOTIONAL EXAMS (a) The civil Service Commission is authorized to adopt and approve promotional examinations con- sisting of one Or more tests in any combination of written, oral, physical, demonstration of skill or an evaluation of training and experiences designed to fairly test the relative capacity of the per- sons examined to discharge the particular duties of th~ position to which promotion is sought. (b) This provision is specifically intended to supersede state code limitations on the design and content of civil service promotional exams. Section 2. It is found and determined tha-t all formal! actions of this Council concerning and relating to the passage of! this ordinance were adopted in an open meeting of this Council, and! that all such deliberations of this Council and of any of its commit- tees that resulted in such formal action were in meetings open to thei public in compliance with all legal requirements. 1
