<br /> AN EMERGENCY ORDINANCE, authorizing and directing the City
<br />Engineer and Director of Public Works to expand the scope of work under
<br />contract with Terrace Construction Company, Inc., and to amend the
<br />contract from Two Million, Six Hundred Sixty Thousand, Four Hundred
<br />Seven (2,660,407) Dollars to Three Million, Two Hundred Forty Thousand,
<br />Four Hundred and Seven (3,240,407) Dollars..

<br /> WHEREAS, the City Engineer and Director of Public Works were
<br />authorized to enter into a contract to furnish all labor or materials
<br />or both, and perform the work necessary to and for a sewer separation
<br />project on Orchard Grove, Rosewood, Westwood, Lakeland and Park Place
<br />in the City pursuant to Ordinance 29-92, and
<br />
<br /> WHEREAS, following bidding procedures in accordance with the
<br />Charter and Ordinances of the City of Lakewood, Terrace Construction
<br />Company, Inc. was awarded the contract for Two Million, Six Hundred
<br />Sixty Thousand, Four Hundred and Seven (2,660,407) Dollars, and
<br />
<br /> WHEREAS, in the course of the project, it was determined by the
<br />City Engineer and the Director of Public Works that it would be in the
<br />best interest of the City to expand the scope of the work, and
<br />
<br /> WHEREAS, the estimated cost to complete the expanded work is
<br />Five Hundred Eighty Thousand (580,000) Dollars, and
<br />
<br /> WHEREAS, this ordinance constitutes an emergency measure
<br />providing for the immediate preservation of' the public health, safety
<br />and welfare and the usual daily operation of a municipal department as
<br />the work on the sewer separation project has already begun and the City
<br />will achieve significant savings by amending the contract and making
<br />changes at this time before the current work is completed; now,
<br />therefore,

<br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. That the City Engineer and Director of Public Works
<br />on behalf of the City of Lakewood be and they are hereby authorized and
<br />directed to modify and amend the contract with Terrace Construction
<br />Company, Inc., for a sewer separation project on Orchard Grove,
<br />Rosewood, Westwood, Lakeland and Park Place in the City to execute the
<br />necessary documents as are acceptable to the Director of Law to protect
<br />the public interest.
<br />
<br /> Section 2. That pursuant to the conditions of the aforementioned
<br />amended contract, Council hereby formally approves the expansion of the
<br />work by Terrace Construction and the expenditure of funds up to Three
<br />Million, Two Hundred Forty Thousand, Four Hundred and Seven (3,240,407)
<br />Dollars in accordance with the terms and conditions set forth therein
<br />and approves and ratifies the actions of the City Engineer, Director Of
<br />Public Works and Law Director as of this date.
<br />
<br /> Section 3. It is found and determined that all formal actions of
<br />this Council concerning and relating to the passage of this ordinance
<br />were adopted in an open meeting of this Council, and that all such
<br />deliberations of this Council and of any of its committees that
<br />resulted in such formal action were in meetings open to the public in
<br />compliance with all legal requirements.

<br /> Section 4. That this ordinance is hereby declared to be an
<br />emergency measure for the reasons stated in the preamble hereof and
<br />provided it receives the affirmative vote of two-thirds of all members
<br />elected to Council, it shall take effect and be in force immediately
<br />
