PLEASE SUBSTITUTE FOR ORDINANCE <br />NO.' 4-9S originally submitted with <br />this evening's docket. <br /> <br />PLACED ON FIRST READING ~ REFERRED <br />TO FINANCE COMMITTEE~n 2/16/93. <br /> <br />ORDINANCE NO. 4-93 <br /> <br /> BY: Boscia, Gallagher, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ORDINANCE, authorizing and directing the <br />Mayor,. on behalf of the City of Lakewood, to enter into a purchase <br />agreement with St. Nicholas Pro,Cathedral, to sell a portion of <br />the City's property located at 14521 Madison Avenue in <br />the City of Lakewood. <br /> <br /> WHEREAS, Council has determined that it is in the best <br />interest of the City to sell said property, recover part of the <br />cost of acquisition and site preparation and to relieve the .City <br />of the obligation to maintain the portion of property not needed <br />for municipal purposes, and <br /> <br /> WHEREAS, the owners of the adjacent property at 2019 <br />Belle Avenue have agreed to purchase the property from the City at <br />the City's cost of Eight Thousand One Hundred Thirty Seven Dollars <br />and Fifty Cents ($8,137.50) subject to approval by Council <br />pursuant to a duly adopted ordinance and final acceptance of the <br />agreement, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety, and welfare, and for the usual daily operation of <br />municipal department; now, therefore, <br /> <br />.BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the Mayor on behalf of the City of <br />Lakewood be and he is hereby authorized and directed to enter into <br />a Purchase Agreement with Saint Nicholas Pro-Cathedral, for the <br />sale of a portion of the property located at 14521 Madison Avenue <br />and described in Exhibit "A" attached hereto and incorporated by <br />reference herein, said Purchase Agreement to be substantially in <br />the form of Exhibit "B" with such additional provisions as are <br />acceptable to the Director of Law to protect the public interest. <br />The purchase price to be Eight Thousand One Hundred and Thirty <br />Sewen Dollars and Fifty Cents ($8,137.50). <br /> <br /> Section 2. That pursuant to the conditions of the <br />aforementioned Purchase Agreement, Council hereby formally <br />approves the sale of said property' hereinabove described, <br />including the terms and conditions set forth herein and approves <br />and ratifies the actions of the Mayor as of this date. <br /> <br /> Section 3. That this Council determines that the sale <br />of a portion of the City's property at 14521 Madison Avenue <br />will further the interests of the City and its residents. <br /> <br /> Section 4. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action were in meetings <br />open to the public in compliance with all legal requirements. <br /> <br /> ~Section 5. That this ordinance is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two-thirds <br /> <br /> <br />
