<br />,~ <br /> <br />PLACED ON FIRST READ:) & REFERRED TO <br />Committee of the Whole on 4/l9/9~. <br /> <br />ORDINANCE NO. 26-93 <br /> <br />BY: Boscia, Gallagher, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br />AN EMERGENCY ORDINANCE authorizing and directing the Mayor to enter <br />into an agreement with the LakewoodCity Schools to enable the City of <br />Lakewood to fund purchases- by the Lakewood city Schools of video production <br />and editing equipment and to partially fund the ongoing operation and <br />maintenance of such equipment. <br /> <br />WHEREAS, the city has granted to Cox Cable Cleveland Area, Inc. a <br />non-exclusive franchise to provide cable television service to the residents <br />of Lakewood, and has renewed said franchise for fifteen years commencing June <br />19, 1987, and <br /> <br />WHEREAS, Cox Cable Company agreed to pay the City a franchise fee <br />of five percent (5%) of the Company's gross monthly subscriber service <br />revenues, less unpaid monthly subscriber service charges, but including any <br />annual or periodic prepayment o£monthly service charges, for the Company's <br />previqus fiscal year. <br /> <br />WHEREAS, the City has deposited two percent (2%) of said five <br />percent {5%) of the franchise feé in a Cable Franchise Trust Fund for the <br />purpose of improving the programming opportunities for community groups and <br />the LakewoodCity Schools, and <br /> <br />WHEREAS, there are currently funds available in the Cable Franchise <br />Trust Fund for said purposes, and <br /> <br />WHEREAS, it is in the City's best interest to enter into an the <br />agreement attached hereto as Exhibit "AU and made a part hereof, to fund <br />specific purchases by the LakewQod city Schools totaling One Hundred Twenty <br />Thousand {$12û,OnO} Dollars, and 'each year thereafter to fund the ongoing <br />maintenance and operation of said equipment in the amount of Twenty Thousand <br />{$20,DOO) Dollars Pßr year; now, therefore, <br /> <br />WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate- pr~servation of the pUblic health, safety, and welfare, and <br />for the usual daily operation of a municipal department and for thé reason <br />that the Board _of Education is expected to approve the Agreement on April 19, <br />1993 and desires to begin purchasing equipment as soon as possible to <br />facilitate public acceSS4 <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Mayor on behalf of the city of Lakewood is <br />hereby authorized and directed to enter into an agreement with the Lakewood <br />City Schools, substantially in the form as :attached hereto as Exhibit "A" and <br />incorporated by reference herein, with such additional provisions as are <br />acceptable to the Director of Law to protect the pUblic interest. <br /> <br />Section 2. That the Finance Director is- hereby author.~zed and <br />directed to payout of -the Cable Franchise Trust Fund the amount of One <br />Hundred Twenty Thousand Dollars ($120,000) to the LakewoOd City Schools <br />fifteen (15) days ·after the effective date of thìsordìnance, and thereafter <br />on January 15th of each year, the amount of Twenty Thousand ($20,000) Dollars <br />to fund the ongoing maintenance and operation of said equipment pursuant to <br />the terms in the Agreement. <br /> <br />Section 3~ It is found and determined that all formal actions of <br />this Council concerning and reLating to the passage of this ordinance were <br />adopted in ~n open- meeting of this Council, and that all such deliberations <br />of this -Council and of Any of its committees that resulted ,in such formal <br />action were in, meetings- open to the public in compliance with all legal <br />requirements. <br />
