PLEASE SUBSTITUTE FOR ORDINANCE NO. 28-93 <br />PLACED ON 1ST Reading on 5/3/93 and on <br />2ND Reading on 5/17/93. <br /> <br />AMENDED <br /> <br />ORDINANCE NO. 28-93 <br /> <br /> BY: Boscia, Ga~gher, <br />George, Gibbons, Roth, Seelie, <br />Smith <br /> <br /> AN EMERGENCY ORDINANCE to amend Chapter 1335 of the <br />Building Code of the Codified ordinances of the City of Lakewood. <br /> <br /> WHEREAS, Chapter 1335 of the Building Code, Paint Removal <br />and Exterior Surface Cleaning, was adopted April 3, 1989, in <br />response to developments in technology which promised homeowners a <br />low cost alternative to traditional paint removal and exterior <br />maintenance, and <br /> <br /> WHEREAS, experience and scientific literature since the <br />enactment of Chapter 1335 indicate unanticipated costs, both <br />financial and environmental, associated with commercial paint <br />remOval methods employing chemicals and/or power equipment, and <br /> <br /> WHEREAS, the risks, potential liability, and expense <br />associated therewith have driven many commercial operators of power <br />paint removal equipment out of the residential market, and <br /> <br /> WHEREAS, adequate regulation of power paint removal <br />technology to protect the public safety requires scientific testing <br />and analysis of the paint to be removed and the Building and Health <br />Divisions are not presently prepared to perform universal testing, <br />and <br /> <br /> WHEREAS, in the present state of scientific knowledge and <br />developing technology, the public interest and safety would be best <br />served by the strict regulation of certain power paint removal <br />procedures under controlled conditions, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety, and welfare, and for the usual daily operation of a <br />municipal department for the reason that lead-bearing airborne <br />particles and dust are particularly hazardous to infants'and <br />children; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1335.01 of Chapter 1335 of the <br />Building Code of the Codified Ordinances of the City of Lakewood <br />now reading as follows: <br /> <br /> 1335.01 PERMIT REQUIRED. <br /> No person shall do any paint removal or exterior surface <br />cleaning of any structure located in the City by sand blasting, <br />steam or high pressure cleaning, power sanding or other similar <br />method without first obtaining a permit therefor from the Building <br />Commissioner. A separate permit is required for each separate job <br />or location at which such activity will be done. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br /> 1335.01 PERMIT REQUIRED. <br /> No person shall do any paint removal or exterior surface <br />cleaning of any structure located in the City by sand blasting, <br />steam or high pressure cleaning, chemical Cleaning, open-flame <br />burning, power sanding or other similar method without first <br />obtaining a permit therefore from the Building Commissioner. A <br />separate permit is required for each separate job or location at <br />which such activity will be done. <br /> <br />Section 2.
