Item <br /> <br />AMENDED <br /> <br />ORDINANCE NO. <br /> <br />32-93 <br /> <br />BY: Boscia, Gallagher, George, <br /> Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ORDINANCE fixing the compensation of the Clerk of <br />the Lakewood Municipal Court, the time and method of payment <br />thereof and repealing Ordinance No. ;64-92 adopted June 17, 1992~ <br /> <br /> WHEREAS, the Municipal Court Act, Revised Code Section 1901.33 <br />provides that the legislative authority of this municipality shall <br />fix the annual salary of the Clerk of Courts, and <br /> <br /> WHEREAS, the Act further provides that the compensation Of the <br />Clerk shall be paid three-fifths from the City Treasury and <br />two-fifths from the Treasury of the County in' which the City is <br />located, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department <br />in that in the interest of public service, welfare, and safety, it <br />is necessary to fix the compensation of the Clerk and direct the <br />time and method of payment thereof; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the compensation of the Cl~rk of the Lakewood <br />Municipal Court is hereby fixed at Fifty-five Thousand Three <br />Hundred Eight-eight Dollars per annum effective April 1, 1993. <br /> <br /> Section 2. That the Director of Finance is hereby authorized <br />and directed to pay three-fifths ($33,'232.80) of the compensation <br />of the Clerk as herein fixed, from the City Treasury in <br />semi-monthly or in equal installments every two weeks. <br /> <br /> Section 3. That Ordinance No. 64-92 adopted June 17, 1992 and <br />all other ordinances or parts of ordinances inconsistent herewith <br />shall be and are hereby repealed. <br /> <br /> Section 4. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 5. <br />emergency measure for the reasons stated in the <br />provided it receives the affirmative vote <br />members elected to Council, it <br />immediately upon its adoption and <br />it shall take effect and be in <br />allowed by law. <br /> <br />That this ordinance is hereby declared to be an <br />;le hereof and <br />of all <br />in force <br /> · <br /> ~st period <br /> <br />Approved .'~ ~ / ~' f3 <br /> <br />Mayor <br /> <br /> <br />
