ORDINANCE NO. <br /> <br />40-93 <br /> <br />BY: Boscia, GallaKher, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Public <br />Works, on behalf of the City, to enter into an agreement with the <br />City of Cleveland pursuant to Lakewood Codified Ordinance section <br />111.04(a)(8) and Ohio Revised Code section 735.053 for the <br />resurfacing of the City of Lakewood's portion of Lakewood Heights <br />Boulevard between Chesterland Ave. and Bunts Rd. <br /> <br /> WHEREAS, Lakewood Heights Boulevard is a heavily trafficked <br />roadway which lies on a boundary between the City of Lakewood and the <br />City of Cleveland, and <br /> <br /> WHEREAS, the citizens of Lakewood rely on Lakewood Heights <br />Boulevard when travelling to, from, and through the City and the ease <br />and safety of such travel will be enhanced through the resurfacing of <br />said boulevard, and <br /> <br /> WHEREAS, by entering into an agreement with the City of <br />Cleveland for the resurfacing of Lakewood Heights Boulevard, the citY <br />of Lakewood will avoid inconvenience to residents and others using <br />said boulevard by allowing both portions of the roadway to be <br />resurfaced simultaneously, and <br /> <br /> WHEREAS, the resurfacing of Lakewood Heights Boulevard <br />between Chesterland Ave. (Joslyn Rd.) and Bunts Rd. (West 140th) will <br />be performed by in-house crews of the City of Cleveland at a total <br />cost of $100,000.00 of which the City of Lakewood's share will be <br />$50,000.00, and <br /> <br /> WHEREAS, this Council has determined that it is in the best <br />interest of the City to authorize the Director of Public Works, for <br />and on behalf of the City, to enter into an agreement with the City <br />of Cleveland to resurface said portion of Lakewood Heights Boulevard, <br />and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the daily operation of a municipal department and the <br />health, safety, and welfare of the citizens of the City in that the <br />City of Cleveland is scheduled to complete the resurfacing of <br />Lakewood Heights Boulevard within the next thirty (30) days and the <br />opportunity to have the entire roadway resurfaced as a single project <br />will otherwise be lost; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the Director of Public Works, for and on <br />behalf of the City, is hereby authorized to enter into an agreement <br />with the City of Cleveland for the resurfacing of the City of <br />Lakewood's portion of Lakewood Heights Boulevard between Chesterland <br />Ave. and Bunts Rd. and to pay to the City of Cleveland a share of the <br />cost not to exceed $50,000.00. Said agreement to contain such terms <br />and conditions and be in such form as the Director of Law deems <br />necessary to protect the public interest. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings open <br />to the~public in compliance with all legal requirements. <br /> <br /> <br />
