S4-93 <br /> <br />BY: 5oz~c/~, Ff. mm~'~, G¢oazj¢, <br /> <br /> AN ORDINANCE to amend the Building Code of the Codified <br />Ordinances of the City of Lakewood by amending Chapter 1308 entitled <br />Flood Damage Prevention Code. <br /> WHEREAS, Section 3 Article XVIII of the Constitution of the <br />State of Ohio grants municipalities the authority to adopt land use <br />and control measures for promoting the health, safety, and general <br />welfare of its citizens; and <br /> WHEREAS, pursuant to such authority and with the purpose of <br />participating in the National Flood Insurance Program (NFIP), ~he City <br />adopted its Flood Damage Prevention Code on Januar~ 16, 1978; and <br /> WHEREAS, the NFIP modeI code has been ~mended since the City <br /> adopted its Flood Damage Prevention Code; and <br /> WHEREAS, the City's Flood Damage Prevention Code must remain <br /> in compliance with the NFIP model code in order to continue to <br /> participate in the NFIP; and <br /> WHEREAS, suspension from the NFIP.woul~ preyer owners of <br /> flood-prone property from securing flood insurance from the Federal <br /> EmergencY Management Agency, which administers the NFIP; now, <br /> ~herefore, <br /> 'BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> OF OHIO: <br /> Section 1. Uses that are <br />inadequately floodproofed, elevated or otherwise <br />protected from flood damage also contribute to the <br />flood loss. <br /> <br /> <br />
