PLACED ON 1ST READING ~ REFERRED TO THE <br />PUBLIC WORKS COMMITTEE ON 10/7/96. <br />PLACED ON 2nd READING ON 10/21/96. <br /> <br />ORDINANCE NO. 39-96 <br /> <br />BY: Boscia, Corrigan, Flannery, <br /> Georgel Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor <br />(Director of Public Safety), the Director of Public Works, and the Director of <br />Finance to solicit Requests for Proposals and enter into a Performance <br />Contract as outlined by the State of Ohio in House Bill 300 for the repair and <br />modernization of existing heating, ventilation, air conditioning, lighting <br />systems, and ice making plant at Winterhurst Ice Rink. <br /> <br /> WHEREAS, an emergency exists to provide for the immediate <br />preservation of public property, health and safety, and to provide for the <br />usual daily operation of municipal departments in that certain capital <br />improvements projects are to be undertaken at Winterhurst in accordance with <br />the Capital Improvement Plan, and <br /> <br /> WHEREAS, Winterhurst Ice Rink expends inexcess of $300,000 a year <br />to purchase electric and natural gas which places Winterhurst in the top ten <br />percent (10%) of energy consumption for ice rinks in North America, and <br /> <br /> WHEREAS, State of Ohio House Bill 300 allows municipalities to <br />employ performance contracting based on guaranteed energy savings as a method <br />of financing capital improvements, and <br /> <br /> WHEREAS, Winterhurst was built in 1975 prior to today's <br />technological advances in energy conservation, and <br /> <br /> WHEREAS, qualified firms exist to repair or modernize existing <br />heating, ventilation, air conditioning, lighting systems, and ice making <br />plants and funding those improvements through guaranteed energy savings, now <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the Mayor (Director of Public Safety), the <br />Director of Public Works, and the Director of Finance are hereby authorized <br />and directed to solicit Requests for Proposals and enter into a performance <br />contract based on guaranteed energy savings with the best bidder in accordance <br />with State of Ohio House Bill 300 and the Codified Ordinances of the City of <br />Lakewood for Energy Savings Improvements at Winterhurst Ice Rink. <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this Ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and any of its committees that resulted in such formal action <br />were in meetings open to the public in compliance with all legal requirements. <br /> <br /> Section 3. That this Ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives an affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its adoption <br />and approval by the Mayor; otherwise, shall take effect and be in force after <br />the earliest period allowed by law. <br /> <br />Presi dent <br /> <br /> <br />
