PLEASE SUBSTITUTE FOR ORDINANCE No.41-96 PLACED ON <br />1ST READING & REFERRED TO COMMITTEE OF THE WHOLE <br />11/4/96; PLACED ON 2ND READING ON 11/18/96. <br /> <br />ORDINANCE NO. 41-96 <br /> <br />BY: <br /> <br /> AN EMERGENCY ORDINANCE establishing a Division of Community <br />Development (DCD) within the Department of Planning and Development to administer <br />Lakewood's Low Interest Loan Programs and other rehabilitation and development <br />programs. <br /> <br /> WHEREAS, Council shall, by ordinance, provide for the organization of the <br />Department &Planning and Development, and <br /> <br /> WHEREAS, Council shall have the power to establish, by ordinance, additional <br />Divisions as the public service may require, and <br /> <br /> WHEREAS, the Community Development Corporation of Lakewood (CDC), an <br />existing non-profit corporation, currently receives Community Development Block Grant <br />(CDBG) fimding directly and solely from the City as authorized by the U.S. Department <br />of Housing and Urban Development (HUD), and <br /> <br /> WHEREAS, Council is of the opinion that such grant dollars can be administered <br />more effieiemly by the DCD than through the existing CDC, thereby increasing the <br />resources available for improving the quality &housing and property values in LakeWood <br />through rehabilitation and other development programs, and <br /> <br /> WHEREAS, Council affirms the continued worth and merit of Lakewood's Low <br />Interest Loan programs and other rehabilitation and development programs as critical to <br />the future of Lakewood, and <br /> <br /> WHEREAS, Council and the Mayor, as members individually of the CDC, desire <br />to voluntarily dissolve and wind up the affairs of the non-profit corporation and facilitate <br />the transfer of all assets, interests and authority to the newly formed DCD, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for the <br />immedime prevention &the public safety and welfare and for the usual daily operation of <br />a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That a Division of Community Development be established, effective <br />January 1, 1997, within the Department of Planning and Development to administer <br />Lakewood's Low Interest Loan Program and other rehabilitation and development <br />programs for the public welfare purpose of enhancing the economic and physical resources <br />of the City of Lakewood and its residents. <br /> <br /> Section 2. That the members of the CDC voluntarily dissolve and wind up the <br />affairs of the non-profit corporation and facilitate the transfer of all assets, interests and <br />authority of the CDC to the newly formed DCD. <br /> <br /> Section 3. That the Board of Trustees of the existing CDC remain a volunteer <br />governing body charged with the authority, oversight and discretion necessary and proper <br />to administer any and ail loan decisions made under the programs &the DCD, effective <br />January 1, 1997. Such Board shall also serve as a program advisory board to the <br />Department of Planning and Development to promote future programming to benefit <br />Lakewood. This governing body shall be titled the "Loan Approval Board for the <br />Division of Community Development", and all Board functions of a magisterial, <br />representative or fiduciary character shall comply with the policies and procedures of the <br />Department of Planning and Development, the Codified Ordinances of the City of <br />Lakewood, and the laws of the State of Ohio. <br /> <br /> <br />
