ORDINANCE NO. 28-98 BY: Corrigan, Flannery, George, Roth, Seelie, Skindell, Smith AN EMERGENCY ORDINANCE to amend Section 313.10 of the Traffic Code of the Codified Ordinances of the City of Lakewood by enacting a restriction to a right turn against a steady red signal at all times at the Hilliard Boulevard and McKinley Avenue intersection. WHEREAS, concern exists for the safety of vehicles entering the Hilliard Boulevard and McKinley Avenue intersection (eastbound) making a turn onto McKinley Avenue (southbound); and WHE~, it has been determined that prohibiting a right turn against a steady red signal at all times for eastbound traffic at this intersection would contribute to the safety of vehicles by removing a potential hazard; and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare; now, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 313.10 (b) of the traffic Code of the Codified C~dina~ces of the City of Lakewood now reading as follows: 313.10 PROHIBITED TURNS ON RED SIGNALS. (b) Pursuant to the provisions of Section 313.03(c)(5), a right turn against a steady red signal is hereby prohibited at all times at the following intersections upon the po~ing and kuq~l~on of the proper si~ giving notice the~of: A. Madison Avenue B. Riverside Drive all four directions all four directions shall be and the Same is hereby amended to read as follows: 313.10 PROHIBITED TURNS ON RED SIGNALS. (b) Pursuant to the provisions of Section 313.03(c)(5), a fight turn against a steady red signal is hereby prohibited at all times at the following intersections upon the posting and install~on of the proper signs giving notice thereof: (5) Hilliard Boulevard A.. B. o C. McKinley Avenue east bound ouly Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council. and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
