<br />Please SUBSTITUTE For ORküANCE NO. 44-98, <br />Placed on 1st Reading & REFERRED to Committee of the Whole 9/8/98. <br /> <br />ORDINANCE NO. 44-98 BY: Corrigan, Roth, <br />Seelie, Skindell, Smith <br /> <br />AN ORDINANCE to submit to theelectprs of the City of Lakewood the <br />question of whether Section 915.02 - Customer Service Charge of the Codified <br />Ordinances of the City of Lakewood shall be repealed. <br /> <br />WHEREAS, a petition for the proposed Ordinançe repealing Section 915.02 <br />of the Codified Ordinances of the City of Lakewood, Customer Service Charge <br />has been submitted; <br /> <br />WHEREAS, it-has been determined that said petition contains sufficient <br />number of valid signatures; <br /> <br />WHEREAS, the committee of the petitioners has requested that the <br />proposed ordinance be submitted to the electors for their approval; <br /> <br />WHEREAS, it is the desire of Council to forthwith make provisions for the <br />submission of said proposed Ordinance to the electorate of the City of Lakewood <br />at the eleçtion to be held on November 3, 1998; <br /> <br />WHEREAS, this Ordinance constitutes an emergençy measure providing <br />for the publiç peace, health, saMy and welfare of the çjtizens of the City of <br />Lakewood by placing the question on the ballot for the November election. <br /> <br />Now, Therefore, be it ordained by the Counçil of the City of L¡¡kewood, <br />Cuyah09a County, Ohio; <br /> <br />Seçtion 1. There shall be submitted to the eleçtors of the City of <br />Lakewood at the election to bé held on November 3, 1998, Section 2 of the <br />proposed Ordinance repealing Section 915.02 of the Codified Ordinances of the <br />City of Lakewood, Customer Service Charge. <br /> <br />Section 2. The ballots for said election shall be entitled "Proposed <br />Ordinance Ballot" and the question to be submitted on said Ballot shall be in the <br />words following: "An Ordinance Repealing the Monthly Water Customer Service <br />Charge contained in S~çtion 915.02 Of the CodifJed Ordinances of the City of <br />Lakewood." In the aþpropriate position below shall be placed the following, "For <br />the Ordinance" and "Against the Ordinance". <br /> <br />Section 3. The Clerk of Council is directed to certify a copy of this <br />ordinance to the Board of Eléctions of Cuyahoga County, and to take all further <br />action required by law relative to the submission of said proposed Ordinance at <br />said election. <br /> <br />Section 4, It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in suçh formal açtions, were in <br />meetings open to the publiç, in compliance with all legal requirements. <br /> <br />1 <br />
