Please SUBSTITUTE For ORküANCE NO. 44-98, Placed on 1st Reading & REFERRED to Committee of the Whole 9/8/98. ORDINANCE NO. 44-98 BY: Corrigan, Roth, Seelie, Skindell, Smith AN ORDINANCE to submit to theelectprs of the City of Lakewood the question of whether Section 915.02 - Customer Service Charge of the Codified Ordinances of the City of Lakewood shall be repealed. WHEREAS, a petition for the proposed Ordinançe repealing Section 915.02 of the Codified Ordinances of the City of Lakewood, Customer Service Charge has been submitted; WHEREAS, it-has been determined that said petition contains sufficient number of valid signatures; WHEREAS, the committee of the petitioners has requested that the proposed ordinance be submitted to the electors for their approval; WHEREAS, it is the desire of Council to forthwith make provisions for the submission of said proposed Ordinance to the electorate of the City of Lakewood at the eleçtion to be held on November 3, 1998; WHEREAS, this Ordinance constitutes an emergençy measure providing for the publiç peace, health, saMy and welfare of the çjtizens of the City of Lakewood by placing the question on the ballot for the November election. Now, Therefore, be it ordained by the Counçil of the City of L¡¡kewood, Cuyah09a County, Ohio; Seçtion 1. There shall be submitted to the eleçtors of the City of Lakewood at the election to bé held on November 3, 1998, Section 2 of the proposed Ordinance repealing Section 915.02 of the Codified Ordinances of the City of Lakewood, Customer Service Charge. Section 2. The ballots for said election shall be entitled "Proposed Ordinance Ballot" and the question to be submitted on said Ballot shall be in the words following: "An Ordinance Repealing the Monthly Water Customer Service Charge contained in S~çtion 915.02 Of the CodifJed Ordinances of the City of Lakewood." In the aþpropriate position below shall be placed the following, "For the Ordinance" and "Against the Ordinance". Section 3. The Clerk of Council is directed to certify a copy of this ordinance to the Board of Eléctions of Cuyahoga County, and to take all further action required by law relative to the submission of said proposed Ordinance at said election. Section 4, It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in suçh formal açtions, were in meetings open to the publiç, in compliance with all legal requirements. 1
