ORDINANCE NO: ' 48- 98 BY: Corrigan, Flannery, George, <br /> Roth, Seelie, Skindell, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor of the City of <br />Lakewood, Oh/o, to enter into a contract with the International Association of <br />Firefighters, AFL-CIO, Local 382. <br /> <br /> WHEREAS, the Administration has conducted extensive negotiations with Local <br />382 of the International Association of Firefighters, as the bargaining representative for <br />the members of the Division of Fire; and <br /> <br /> WHEREAS, a Factfinder's report dated June 1, 1998, was accepted by the Union, <br />and along with other agreements reached, have provided a Tentative Agreement between <br />the parties for the years 1998, 1999 and 2000; and <br /> <br /> WHEREAS, Council and the Administration have reviewed such proposal and do <br />desire to ratify and adopt such agreement; and <br /> <br /> WHEREAS, this Ordinance consntutes an emergency measure providing for the <br />immediate preservation of the public health, safety and welfare, and for the usual daily <br />operation of municipal services; now, therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1: That the Mayor be and is hereby author/zed and directed to enter <br />into an Agreement with the International Association of Firefighters, AFL-CIO, Local <br />382, on behalf of the members of the Division of Fire, on the terms and conditions, <br />contained in the Agreement, which is made a pan hereof as though fully rewritten herein, <br />a copy of which is on file in the Office of the Director of Law, and as approved by the <br />Director of Law. <br /> <br /> Section 2: It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this Ordinance were passed in an open meeting <br />of this Council and that all deliberations of this Council and any of its committees that <br />resulted in snch actions were in meetings open to the public and in compliance with legal <br />Requirements. <br /> <br /> Section 3: That any and all ordinances in conflict with the express provisions <br />of this Agreement are superseded by this Agreement. <br /> <br /> Section4: That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take effect and <br />be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall <br />take effect and be in force after the earliest perio~d all~. ed by law. <br />Adopted: _&,~./~.~ff//~l~ . . .. ~], ~.~x~2.~, <br /> President <br /> <br /> Mayor <br /> <br /> <br />
