<br />AN EMERGENCY ORDINANCE amending Section 521.14 of the General
<br />Offenses Code of the Codified Ordinances of the City of Lakewood,
<br />
<br />WHEREAS, existing Section 521.14 of the General Offenses Code of the
<br />Codified Ordinances, approved by Lalœwood City Council in 1979, is now obsolete,
<br />hav;ng been preempted by Section 2927,02 of the Ohio Rev;sed Code; and,
<br />
<br />WHEREAS, this ordinance will amend existing Section 521.14 of the General
<br />Offenses of the Codified Ordinances so it confonns to Section 2927,02 of the Ohio
<br />Revised Code, thereby making the City's ordinance prohibiting the sale of tobacco to
<br />minors consistent with state law; and
<br />
<br />WHEREAS, this ordinance constitutes an emergency measure necessary for the
<br />immediate preservation of the public peace, property, health, safety and welfare in the
<br />City; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO'
<br />
<br />Section I That Section 52114 of the General Offenses Code of the Codified
<br />Ordinances of the City of Lakewood, now reading as follows':
<br />
<br />521 14 SALE OF TOBACCO TO MINORS PROHIBITED
<br />(a) No person shall sell, give or furnish to a person under eighteen years
<br />öf age a cigarette, cigarette wrápper or substitute for either, or a cigar or tobacco
<br />
<br />(b) Every place in the City where tobacco products are sold shall display
<br />at all times in a prominent place on the premises tbereof, a printed card which
<br />shall be furnished by the City and which shall read substantially as follows:
<br />"Under the ordinances of the City of Lakewood. it is .unlawful to
<br />sell, give or furnish to a person under eighteen (18) years of age a
<br />cigarette or other tobacco products ..
<br />
<br />(c) Whoever violates any provision of this section is guilty of a minor
<br />misdemeanor,
<br />
<br />shall be and the same is hereby amended:
<br />

<br />MACHINES.
<br />(a) No manufacturer, producer. distributor. wholesaler, or retailer of
<br />cigarettes or other tobacco products, or any agent, employee, or representative. of
<br />a manufacturer. producer, distributor. wholesaler, or retailer of cigarettes or other
<br />tobacco products shall do any of the following:
<br />(1) Give, sÿll, or otherwise distribute Cigarettes or other tobacco
<br />products to any person under eighteen years of age;
<br />(2) Give away. sell, or distribute cigarettes or other tobacco products
<br />in any place that does not have posted in a conspicuous place a
<br />sign stating giving, selling, or otherwise distributing cigarettes or
<br />other tobacco products to a person under eighteen years of age is
<br />prohibiied by law,
<br />
<br />(b) No person shall sell or offer to sell cigarettes or other tobacco
<br />products by or ITom a vending machine except in the following locations:
<br />
<br />(J) An area either:
<br />(A) Within a factory, business, office, or other place not open
<br />to the general public; or
<br />
