ORDINANCE NO. i'-99 hB,yCorriga~, FitzGerald, George, <br /> Rot_:Seelie, Skinde!l, Smith <br /> AN EMERGENCY ~RDINANCE to amend the agreement with Bay <br />Village, Fairview Park, North OIr-s~ed. Rocky River and Westlai(e. establishing the <br />Westshore Council of Governments and authorizing the Mayor to enter into the <br />Amended Agreement. <br /> <br /> WHEREAS, as provided in Chapter 167 of the Ohio Revised Code, the <br />City has entered into an Agreement with the Cities of Bay Village, Fairview Park, North <br />Olmsted, Rocky River 'and Westlake. and established a Regional Council of <br />Governments known as the Westsnore Council of Governments, which Council has the <br />powers and duties set forth in the Ohio Revised Code and as contained in the <br />Agreement between the member Cities: and <br /> <br /> WHEREAS. bhe Westshore Council of Governments. established asset <br />forth above, has determined that various amendments are required in the agreement <br />establishing the Westshore Council cf Governments together with the Westshore <br />Enforcement Bureau by-laws created thereunder; and <br /> <br /> WHEREAS. the amendments and changes in such agreement and by- <br />laws are for the most part technical in nature and it is more appropriate to adopt a <br />restated and amended agreement containing such changes, which is attached hereto <br />and marked as Exhibit "A"; and <br /> <br /> WHEREAS, it has been determined that it is in the best interest of each of <br />the member Cites and their residents to authorize the Council in the agreement formed <br />under Chapter 167 of the Ohio Revised Code to provide additional Law Enforcement <br />Services throughout the temtory and jurisdictions of the member Cities; and <br /> <br /> WHEREAS, Ohio Law requires that such grant of authorfty be expressly <br />authorized by the member Cities in the basic contract between the members of a <br />regional council of governments organized under Chapter 167 of the Ohio Revised <br />Code: and <br /> <br /> WHEREAS, such a grant of authority is in the interest of the health, <br />welfare and safety of all residents of the member Cities and is consistent with the <br />authority granted to municipal comorations under Ohio Revised Code section 737.041; <br />and <br /> <br /> WHEREAS. the amendment of the present agreement between the <br />member Cities of the Westshore Council of Governments as set forth below will <br />enhance safety and contribute to the effectiveness of the Westshore Council of <br />Governments in meeting the intended improvements in the public peace, health, safety <br />and welfare of the City of Lakewocd and the other member Cities. <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD. STATE OF OHIO <br /> <br /> Section 1. That the Mayor be authorized and directed to execute the <br />amended agreement creating the Westshore Council of Governments in the form and <br />content presented to this Council attached herewith, marked Exhibit "A" and made a <br />part hereof, with any minor revlmons and modifications desired by the other member <br />Cities of the Westshore Council of Governments consistent with this ordinance as may <br />be approved by the Director of Law. <br /> <br /> Section 2. That any Ordinances or parts of Ordinances in conflict <br />herewith are hereby repealed. <br /> <br /> Section 3. It is fcund and determined that all formal actions of this <br />Council concerning and retating ;c the oassage of this ordinance were adcnted in an <br /> <br /> <br />
