Placed on <br /> 2nd Reading 5/3/99. <br /> <br /> BY: Corrigan, FitzGerald, George. <br />Roth, Seelie, Skindell, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Director of <br />Finance to sell, through public auctions, various obsolete, surplus and non-functioning <br />Cin.' vehicles, materials and/or equipment. <br /> <br /> WHEREAS, it is in the best interest of the City to sell this obsolete, surplus and <br />non-funetiuning equipment to make better use of the space it occupies and to realize a <br />profit from the sale, and <br /> <br /> WHEREAS, an emergency exism to provide for the immediate preservation of <br />public property, health and safety, and to provide for the usual daily operation of <br />municipal departments, now therefore: <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Finance be and she is hereby authorized and <br />directed to sell, through public auctions, held in the spring and the fall, various obsolete, <br />surplus and non-functioning City vehicles, ma_Lerials and/or equipment after advertising <br />according to law. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open meeting <br />of this Council, and that all ~uch deliberations of this Council and of any of its <br />con. trees that resulted in such formal action, were in meetings open to the public in <br />compliance with all legal requirement~ <br /> <br /> Section 3. This ordinance is hereby declared an emergency measure for the <br />rea.sous stated in the preamble hereof and prox~ded it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by {he Mayor, otherwise, it shall mite effect and be in <br />force a/ter the earliest period allowed by law. <br /> <br />APPROVED: <br /> <br />President <br />M~or I - <br /> <br /> <br />
