ORDINANCE NO 35 - 9 9 BY- Corrigan, FitzGerald, George, Roth, Seelie, Skindell, Smith AN EMERGENCY ORDINANCE fixing the compensation of the Clerk of the Lakewood Municipal Court, the time and method of payment WHEREAS, the Municip¡¡ Court Act, Revised Code Section 190131 provides that the legislative authority of this municipality shall fix the annual salary of the Clerk of Courts, and WHEREAS, the Act further provides that the compensation of the Clerk shall be paId three-fifths ITOm the City Treasury and two-fifths ITom the Treasury of the County in which the City is located and, WHEREAS, the ordinance 'constitutes an emergency measure providing for the usual daily operation of a municipal departm¢nt in that in the interest of public service, welfare, and safety, it is necessary to fix the compensation of the Clerk and direct the time and method of payment thereof, now, therefore, BE IT ORDAINED BY THE CIty OF LAKEWOOD, STATE OF OHIO Section 1. That the compensation of the Clerk of the Lakewood Municipal Court is hereby fixed at Seventy Three Thousand Eight Hundred Eighty Seven Dollars per annum effective April 1, 1999 Section 2. That the Director of Finance is hereby authorized and directed to pay three- fifths of the compensation of the Clerk as herein fixed, ITom the City Treasury in semi-monthly or in equal instalhnents every two weeks , Section 3 That Onlinance no 47-98 adopted October 20, 1998 and all other ordinances or parts of ordinances inconsistent herewith shall be and are hereby repealed. l Section 4 It is found and detenIÙned that all formal actions of tms Council concerning and relating to the passage of tJús ordinance Were adopted in an open meeting of this Council, and that all such deliheration of tms Council and any of its committees that resulted in such formal action were in meeting open to the public in compliance with all legal requirements Section 5 That this ordinance is hereby declared to be an emergency measure for the reasons stated in' the preamble hereof and provided it receives the affirmative vote' of two-thirds of all members elecred to Council, it shall take effect and be in force immediately upon its adoption and approval by the MaYOr; otherwise, it shall take effect and be in force after the earliest period allowed by law Adopted: (}rU~ /.3, /119 q~.~ President Approved () NIt1 J! ~ ti7 5' ~¡;k a or
