PLACED ON SECOND <br />READING MARCH 6, 2000. <br /> <br /> ORDINANCE NO 22-00A: BY:Corrigan, FitzGerald, George, <br /> Roth, Seelie, Skindell, Smith. <br /> <br /> AN ORDINANCE to create Chapter 154 entitled "PLANNING COMMISSION" within Part One - <br />Administrative Code, '~tie Five - Administrative - of the Codified Ordihances of the City of Lakewood. <br /> <br /> WHEREAS, the City has initiated and implemented a number of programs in an attempt to upgrade <br />and improve the residential and commercial properties in the City; and <br /> <br /> · WHEREAS, Article XV, Section 3 of the Lakewood City Charter empowers the Planning Commission <br />to "...make plans and proposals for specific improvements and projects which it deems desirable for the <br />City...and to have such other powers and functions as may be imposed by City Council by ordinance or <br />resolution"; and <br /> <br /> WHEREAS, on February 16, 2000 the Planning Commission has adopted design guidelines for use <br />by the Architectural Board of Review, and recommends the periodic review and amendment of such <br />guidelines and addition of new guidelines as necessary; and <br /> <br /> WHEREAS, such guidelines protect existing residential uses thereby protecting property values; and <br /> <br /> WHEREAS, such guidelines encourage the orderly development and retention of commercial uses in a <br />manner consistent with the Community Vision; and <br /> <br /> WHEREAS, through such guidelines the Architectural Board of Review can accomplish its purposes <br />which are to protect the value, appearance and use of property on which buildings are constructed or <br />altered, to maintain a high character of community development, to protect the public health, safety, <br />convenience and welfare and to protect real estate within the City from impairment or destruction of value; <br />now, therefore, <br /> <br /> BE 1T ORDAINED BY THE COUNCIL OF 'I'HE crI'Y OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section :1. That the new Chapter :154 - Planning Commission of Part One lqtle Five of the <br />Codified Ordinances of the City of Lakewood be enacted to include new Section .0! to read as follows: <br /> <br />Section 154.01 Design Standards and Guidelines Adopted <br /> <br /> The Planning Commission at the recommendation of the Administration or City Council, shall <br />periodically adopt, review and amend the Architectural Standards Workbook and any other design <br />standards and guidelines deemed necessary for use by the Architectural Board of Review. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council concerning and <br />relaUng to the passage of this Ordinance were adopted in an open meeting of this Council, ahd that all such <br />deliberations of this Council and of any of its committees that resulted in such formal action were in <br />meetings open to the public in compliance with all legal requirements, <br /> <br />President <br /> <br />Approved: <br /> <br />Cler[~ Council// ~-' ~- <br />Mayc~r <br /> <br /> <br />
