ORDINANCE NO 22-00A: BY:Corrigan, FitzGerald, George, Roth, Seelie, Skindell, Smith. AN ORDINANCE to create Chapter 154 entitled "PLANNING COMMISSION" within Part One - Administrative Code, '~tie Five - Administrative - of the Codified Ordihances of the City of Lakewood. WHEREAS, the City has initiated and implemented a number of programs in an attempt to upgrade and improve the residential and commercial properties in the City; and · WHEREAS, Article XV, Section 3 of the Lakewood City Charter empowers the Planning Commission to "...make plans and proposals for specific improvements and projects which it deems desirable for the City...and to have such other powers and functions as may be imposed by City Council by ordinance or resolution"; and WHEREAS, on February 16, 2000 the Planning Commission has adopted design guidelines for use by the Architectural Board of Review, and recommends the periodic review and amendment of such guidelines and addition of new guidelines as necessary; and WHEREAS, such guidelines protect existing residential uses thereby protecting property values; and WHEREAS, such guidelines encourage the orderly development and retention of commercial uses in a manner consistent with the Community Vision; and WHEREAS, through such guidelines the Architectural Board of Review can accomplish its purposes which are to protect the value, appearance and use of property on which buildings are constructed or altered, to maintain a high character of community development, to protect the public health, safety, convenience and welfare and to protect real estate within the City from impairment or destruction of value; now, therefore, BE 1T ORDAINED BY THE COUNCIL OF 'I'HE crI'Y OF LAKEWOOD, STATE OF OHIO: Section :1. That the new Chapter :154 - Planning Commission of Part One lqtle Five of the Codified Ordinances of the City of Lakewood be enacted to include new Section .0! to read as follows: Section 154.01 Design Standards and Guidelines Adopted The Planning Commission at the recommendation of the Administration or City Council, shall periodically adopt, review and amend the Architectural Standards Workbook and any other design standards and guidelines deemed necessary for use by the Architectural Board of Review. Section 2. It is found and determined that all formal actions of this Council concerning and relaUng to the passage of this Ordinance were adopted in an open meeting of this Council, ahd that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, President Approved: Cler[~ Council// ~-' ~- Mayc~r
